제주특별자치도 의회 교육의원 선거제도의 법적 문제점과 개선방안

국문 초록

교육의 자주성･전문성과 정치적 중립성을 구현하기 위하여 구상된 제주특별자치도의회 교육의원 제도는 그 취지에도 불구하고 현실의 선거에서는 초･중등 교장 또는 교감 등의 오랜 경력을 가진 남성 인사가 주로 입후보하여 당선되며, 선거가 시행될수록 현직 교육의원의 우위가 강화되어 후보자가 1인인 선거구가 다수 등장하여 직접선거 원칙에 상당한 문제를 야기하고 있으며 당선자가 점차 고령화되고 있다는 등의 문제가 나타난다. 이러한 문제는 교육의원 입후보에 5년 이상의 교육 또는 교육행정 경력을 요구하며 별도의 선거구를 통하여 주민이 직접 선출하는 선거제도와 긴밀한 관련성을 가진 것으로 판단된다. 따라서 교육의원 선거제도에서 입후보 자격요건으로 요구되는 5년 이상의 교육 또는 교육행정경력은 폐지하는 것이 바람직하며 교육의 전문성을 요구한다고 해도 보다 덜 제한적인 형태인 교육 전문가(교원 등) 일정 수 이상의 서명을 받는 방법 등을 도입할 수 있다. 나아가 교육의 전문성이 교육 전문가의 교육 독점을 말하는 것이 아니며 교육의원이 심사하는 교육 관련 안건이 교육에 관한 정책의 수립과 시행이나 교육에 관한 정치적 합의 등이라는 점에서 교육의원 자격요건으로 교육 경력 등을 요구하는 것은 불필요하다. 결론적으로 교육의원 제도는 폐지하고 도의원으로 하여금 교육에 관한 사무를 담당하도록 하는 것이 적절한 문제해결의 방향이라는 점을 강조하였다.

영문 초록

Despite the purpose of the election system for Jeju Self-governing Province Council’s education committee members, which was devised to realize the independence, professionalism and political neutrality of education, in actual elections, male personnel with long careers, such as primary and secondary principals or vice principals, are mainly candidates and elected. As it is implemented, the predominance of incumbent education committee members is strengthened, leading to the emergence of most electoral districts with single candidates, causing considerable problems in the principle of direct elections, and problems such as the aging of the elected. These problems arise from requiring 5 or more years of education or educational administration experience for candidates for education committee members and it is judged to be closely related to the electoral system directly elected by residents through separate electoral districts. Therefore, it is desirable to abolish the requirement of education or education administration experience of 5 or more years, which is required for candidates for education committee members, and even if it requires professionalism in education, a less restrictive form, such as a method of obtaining more than a certain number of signatures from educational experts (teachers, etc.) can be introduced. In addition, since education expertise does not refer to the monopoly of education experts, and education-related agendas reviewed by education committee members are the establishment and implementation of education policies and political agreements on education. In conclusion, I tried to emphasize that the abolition of the election system for education committee members and having the provincial council in charge of education related affairs is an appropriate direction of problem solving.
