교육기본법의 법체계상 위상 및 효력과 체계적합성 검토

국문 초록

교육법 전체의 체계를 형성해감에 있어서 교육기본법의 역할을 정립하는 것이 무엇보다 중요하다. 교육기본법은 헌법과 개별 교육법 사이에서 가교 역할을 하여야 한다. 정부와 국회의 교육기본법 운용에 문제가 많다. 학계가 이 법의 위상과 역할에 대한 정립에 적극 나서야 한다. 현재 교육법학계에서는 교육기본법의 역할에 대해 다양한 시각의 차이를 보이고 있다. 그 가운데 일부에서는 종종 교육기본법을 헌법에 준하는 위상과 효력을 갖는 것으로 보기도 한다. 일본에서 교육기본법을 개별 교육법보다 우월한, 준헌법적 효력을 갖는 것으로 보고 있는 점을 받아들이고자 하는 것이다. 그러나 일본 교육기본법의 이러한 위상과 효력의 국내 수용 여부와 관련하여서는 적어도 세 가지 점에서 본질적인 물음과 검토가 필요하다. 일본에서 기본법에 이러한 위상과 효력을 인정하는 것이 교육기본법뿐인가, 만일 다른 기본법들에도 같은 위상과 효력을 인정한다면 일본에서 기본법은 법체계상 하나의 독자적인 입법형식으로 존재하고 역할을 하는 것인가, 위의 이러한 물음들이 모두 인정된다면 일본의 이러한 법체계를 우리나라에도 그대로 수용할 수 있는가 하는 물음이 그것들이다. 본 연구는 이러한 세 가지 물음을 검토하고 그 답을 얻는 것을 주된 목적으로 하며, 세 가지 내용을 구체적으로 다룬다. 첫째, 우리나라에서의 교육기본법에 대한 학설과 판례에 대해 검토한다. 둘째, 일본 법학계에 통용되는 기본법론 검토 및 우리나라 교육기본법을 일본의 그것에 준하여 보는 것의 문제점을 지적한다, 셋째, 그 결과를 토대로 우리나라 교육기본법이 체계 형성적 기능을 제대로 하도록 법 자체의 체계적합성을 갖추기 위한 방안을 검토한다.

영문 초록

It is most important to establish the role of the Framework Act on Education in shaping the entire system of education laws. The law shall serve as a bridge between the Constitution and the Individual Education Act. There are many problems in the operation of the law of the government and the National Assembly. Therefore, the academic community should actively establish the status and role of this law. Currently, there are various views on the role of the law in the field of education law. In some cases, the Framework Act on education is often viewed as having a constitutional status and effect. The move is aimed at accepting Japan s view of the law as having a superior and quasi-constitutional effect than individual education laws. However, there are at least three essential questions and considerations regarding the status and effect of the Framework Act on Education in Japan. Is it only the education law that recognizes this status and effect in the basic law in Japan, if the same status and effect are recognized in other basic laws, does the basic law exist and play a role in the legal system? If all of these questions above are recognized, they are questions about whether Japan s legal system can be accepted in Korea. The main purpose of this study is to review these three questions and obtain their answers, and to address three specifically. First, we examine the theories and precedents of the Framework Act on Education in our country. Second, it points out the problems of reviewing basic legal principles that are prevalent in the Japanese legal community and viewing the basic laws of education in Korea in accordance with those of Japan. Third, based on the results, we need to have a system formation function of the law in Korea and its own systematic suitability.
