자율형 사립고등학교 재지정 취소의 공익 정당성 검토

국문 초록

최근 자사고 재지정 취소처분을 취소하는 법원의 1심 판결이 있었다. 판결의 요지는 자사고 재지정 취소의 공익의 중대성을 인정할 수 없다는 것이다. 자사고 재지정 취소의 공익은 고등학교 교육의 정상화 및 교육기회 배분의 형평성으로 볼 수 있다. 고등학교 교육기회 배분은 대학입시와 직결되므로 국민적 관심과 논란이 많다. 이 연구는 자사고 재지정취소의 공익이 무엇인지, 그것이 중대한 공익인지를 Rawls의 정의의 제2원칙을 기준으로 검토하였다. 자사고 입학전형이나 교육과정은 Ralws의 정의의 제2원칙중 공정한 기회 균등의 원칙의 허용범위를 넘었다고 평가할 수 없다. 또한 자사고 지정 및 취소에 따른 최소 수혜자는 다를 수 있으므로 자사고 재지정 취소에 따른 기대이익과 효과에 대한 보다 면밀한 검토가 필요하다. 자사고 폐지는 학생과 학부모의 교육받을 자유를 제한하므로 고등학교 교육정상화, 교육기회 배분적 정의 실현의 분명한 근거가 제시되어야 한다. 당국이 제시한 자사고 재지정 취소의 공익의 중대성을 인정할 수 없으므로 법원의 판결은 정당하다고 본다. 자사고 폐지 전에 일반고 등 역량 강화 등 고등학교 교육 개혁과 지원 등이 충분하였는지 검토해야 한다.

영문 초록

This study is to justify the korean autonomous private high school policy based on the Rawls justice principles. Based on statistical datas, public documents and academic results related to korean autonomous private high schools, the authoritative warrants of Rawls principles of justice and the backing warrants of private high school policy, this study for abolishing autonomous private high school system is demonstrated the public benefits and justice. The enterance system or curriculum of korean private high autonomous schools is not be evaluated as violating fair equality of opportunity principle of Ralws’t second principle. Furthermore, because the least advantaeged members may be changed by maintaining or abolishing the korean autonomous private high scool system, it will be needed to more calculate profits and effects of the autonomous private high school system. Abolishing of korean autonomous private high schools restricts students and parents freedom for their child’s education, so it will be more needed clear reasons of good high school education and educational opportunities The source of social conflict in our high school policy lies in the absence of consensus on relieving of academical cliquism and fair college entrance system. The social arguments of high school diversification policies to alleviate shortcomings of the high school standardization policy should be discussed again after resolving such pre-emptive issues.
