국문 초록

감정평가사제도는 공정하고 객관적인 감정평가를 통해 국민의 재산권 보호와 국가경제 발전이라는 공공복리의 달성을 위하여 헌법상 기본권인 직업선택의 자유를 제한하면서 마련된 제도이다. 따라서, 국가공인 전문자격사인 감정평가사에게는 공공에의 봉사정신을 사명으로, 고도의 윤리의식이 요구된다고 할 수 있다. 전문자문자격사제도의 특성이자 전문자격사에게 요구되는 덕목으로 전문성, 신뢰성, 독립성, 단체성 등을 들 수 있으나, 이들 모두 감정평가사제도에서 요구되는 공익성이라는 대전제 하에 논의되어야 하는 한계가 존재한다. 감정평가사제도의 전문성이 구체화 되는 업무영역과 업무대상으로서의 “토지등”은 감정평가 주체에게 업무의 독자성이 인정된다는 측면에서, 제도의 본질인 공공성과 현재 업계가 직면하고 있는 전문성의 정도에 대한 점검을 통해 고찰되어야 한다. 감정평가사가 직면하는 대부분의 윤리 문제는 전문자격사로서의 사회적 책임과 사경제 주체로서 사익추구유인 간 충돌에서 발생한다. 따라서, 감정평가제도의 발전은 양자의 조화를 추구하는 방향으로 정립될 당위성이 존재한다. 감정평가제도의 신뢰성과 독립성의 문제는 상기 두 가치 중 어떠한 것이 우선되느냐로 평가될 수 있다. 협회의 역할 역시 대립 되는 두 가지 가치의 균형 유지에 초점이 맞춰져 있다. 따라서 협회는 구성원의 이익을 대변할 수 있어야 함과 동시에 스스로를 통제할 수 있어야 한다. 협회는 감정평가사제도의 전문성과 신뢰성 그리고 공공성이 집대성되고 발현될 수 있는 창구인 만큼 그 역할의 중요성이 강조된다.

영문 초록

The appraiser system was established to protect people s property rights through fair and objective appraisal, and to achieve public welfare and national economic development by limiting the freedom to choose a profession, which is a fundamental right guaranteed under the constitution. Therefore, a high level of ethical standards with a mindset to serve the public is required of the nationally certified professional appraiser. Even though virtues such as professionalism, reliability, independence, and a collective nature are required of the appraisers, all of them have limitations that must be discussed under the premise of public interest required in the appraisal system. The fields of work in which the expertise of the appraisal system is applied, such as “land ownership,” should be examined in consideration of the nature of the system, its publicness, and the degree of expertise required in the industry as the appraisers are acknowledged for their independence. Most of the ethical issues faced by appraisers arise from the conflict between social responsibility as an industry professional and the pursuit of private interests as a private economic actor. Therefore, there is a justification for developing the appraisal system toward the direction of pursuing harmony between these two objectives. The reliability and independence of the appraisal system can be assessed by which of the two values takes precedence. The role of the appraisers’ association is also focused on balancing the two opposing values. Therefore, the association must be able to represent the interests of its members while also being able to control itself. The importance of the association’s role is critical enough to be emphasized as a window through which the expertise, reliability, and publicness of the appraisal system are put together and expressed.
