통일시대 조달청의 역할 및 방향에 관한 연구

국문 초록

한국이 통일하게 된다면 독일의 신탁관리청과 유사한 기구를 정치적으로 결정할 것으로 예상된다. 이러한 정치적 기구를 통하여 북한지역의 국영기업, 공기업, 공장기업소 및 집단농장 등의 민영화를 추진하도록 할 것이다. 조달청은 국유재산 관리기능을 계속 확대하고 있고 통일 이후 북한지역의 SOC 건설 등 재정지출 대부분이 조달청을 통해 집행될 것이기 때문에 우리가 통일이 될 경우 조달청이 이에 대한 역할을 할 준비를 소홀히 하지 않는다면 통일시대 조달청의 역할은 더욱 확대될 것이다. 독일 통일 이후 국내의 몇몇 학자들은 남한이 주도하는 흡수통일을 전제로 독일의 몰수토지 처리 방식을 그대로 통일 한국에 적용하려는 경향을 보이고 있다. 그 중에는 독일의 반환 혹은 보상 방식을 적용해서는 안된다는 입장도 있고 반대로 적용해야 한다는 입장도 있다. 과연 독일의 방식을 그대로 통일 한국에 적용하는 것은 문제가 없을까. 북한의 국가성을 인정하지 않는 흡수통일이 진행될 경우 북한 돌수토지의 원소유자들은 사유재산제도의 원칙을 내세워 무작정 소유권회복을 주장할 가능성이 크고 북한에 토지사유제가 급격하게 되입되기를 바라는 세력들은 이들의 주장을 강력 지원할 것으로 예상할 수 있다. 그럴 경우 독일 사례에서 보듯이 일대 혼란이 발생할 가능성이 크며 이와 같은 독일 사례를 예방하기 위해 여러가지 사유화 방식을 시뮬레이션을 해 볼 필요가 있을 것으로 판단된다. 통일독일의 사례에서 보듯 국유재산의 사유화는 고도의 정치적·경제적이면서도 종합적인 고려가 필요한 행위였다. 조달청이 이런한 역할 수행을 위해 종합적인 청사진을 미리 준비한다면 통일시대 북한지역 국유재산관리의 중추기관이 될 것이다.

영문 초록

If Korea achieves unification, it is expected that establishment of organization for political discretion such as Germany’s Treuhandanstalt. Then, it will be promoting privatization to state enterprise, public enterprise, factory enterprise, and collective farm in North Korea area through the organization. Because Public Procurement Service continuously expands management function for national property and executes financial expenses for SOC construction in North Korea area, if Public Procurement Service does not neglect a role for preparation on unification, the role of Public Procurement Service will be increased in period of unification. After Germany’s unification, some of domestic experts have inclining that intactly applies the method of Germany’s expropriation of land in unified Korea. Some of them insist that Germany’s method on restitution and compensation is not applied, but others insist that the method is applied. If Germany’s method is intactly applies, does it have no problem in unified Korea? In case that absorbing unification which does not acknowledge the nation statehood of North Korea is progressed, it is expected that original owner are bound to arguing restoration ownership following principle of the private property system, and the people who wants rapidly adopting private ownership system of land supports the opinion. In that event, there are lots of chaos in the whole area such as Germany’s case, so it is judged that need to do simulation on lots of privatization methods for preventing Germany’s case. As it sees on case of unified Germany, reformation from national property to privatization needs not only comprehensive consideration but also intensive political stuff and economical stuff. So, if Public Procurement Service prepares comprehensive Master Plan in order to implement the role in advance, it will be a vital organization for management of national property on unified period in North Korea area.
