국문 초록

정부조달 시장은 각 국가의 GDP 중 약 10~25%를 차지하고 있는 거대한 시장이다. 세계 정부조달시장이 개방되면 정부의 조달가격이 낮아지고 조달하는 물품과 서비스의 품질이 향상되어 정부의 효율성이 향상되고 국민의 세금부담이 감소된다. 또한 해외 정부조달이 개방됨으로서 국내기업의 해외진출이 용이해 진다. 이러한 논리를 바탕으로 일부 WTO 회원국들은 정부조달의 시장개방을 추진하고 있다. 그러나 정부조달 시장의 규모에도 불구하고 정부조달에는 WTO의 협정들이 적용되지 않고 있다. 또한, 일부 개도국들은 정부조달을 경제개발의 도구로 활용하고 있고, 정부조달에 따르는 정치적 민감성 때문에 아직도 대다수의 WTO 회원국들은 정부조달 시장개방에 대해서 소극적인 입장을 보이고 있다. 2001년부터 진행되고 있는 WTO 도하라운드(DDA: Doha Development Agenda) 협상에서는 정부조달에 관련, 3개의 협상이 동시에 협상되고 있다. 이 3개의 협상은 정부조달시장의 일반적 시장개방과 각종 규제에 대한 제한사항을 규정하고 있는 정부조달협정(GPA), 서비스 정부조달에 대한 규정을 규정하고자 하는 GATS(General Agreement on Trade in Services), 그리고 정부조달의 투명성을 제고하기 위한 각종 규제를 규정할 정부조달 투명성협정이다. 본 논문에서는 WTO내의 정부조달에 관한 규정, 그리고 협상현황을 살펴보면서 WTO의 정부조달 규정의 각종 문제점들을 지적하고, WTO 차원에서 협상이 어떠한 방향으로 전환되어야 할지를 검토하고 있다.

영문 초록

Globally, the size of the market for government procurement is a very large market, about 10~25% of a country s GDP. If the government procurement market is liberalized, it is believed that the efficiency of government will increase due to reduced prices and higher level of quality for goods and services procured by the government. Also, efficient domestic businesses will have an increased opportunities to export abroad, to foreign governments. Thus, some WTO member countries have actively pursued the liberalization of the global government procurement market in the context of the WTO. However, currently, most WTO agreements exclude government procurement. Most developing countries are reluctant to open their government procurement market, due to the political problems involved. In addition, many developing countries use selective government procurement as a development tool, and do not wish to give it up. In the latest WTO negotiating round, the Doha Development Agenda (DDA), there are three negotiations which deal directly with government procurement: the negotiation for GATS which involve government procurement in services, the issue of transparency of government procurement which is one of the Singapore Issues and the plurilateral Government Procurement Agreement. This paper first examines aspects of current WTO agreements with regard to government procurement, then looks at the current state of DDA negotiations, and makes some suggestions on what path the negotiations should take.
