산업안전보건기준에 관한 규칙 중 기계, 기구 및 그 밖의 설비에 의한 위험예방 개선 방향 연구

국문 초록

산업안전보건법은 1981년 12월 제정된 이후 1990년 1월 전면 개정하였고, 28년만인 2018년 10월에 전면 개정 공포하였다. 산업안전보건법은 산업 안전 및 보건에 관한 기준을 확립하고, 그 책임의 소재를 명확하게 하여 산업재해를 예방하고, 쾌적한 작업환경을 조성함으로써 노무를 제공하는 자의 안전 및 보건을 유지·증진함을 목적으로 한다(법 제1조). 법에서 요구하는 세부 사항은 산업안전보건기준에 관한 규칙에서 세부적으로 규정하고 있으며, 그 중 제2편 안전기준, 제1장 기계, 기구 및 그 밖의 설비에 의한 위험예방에 관한 사항을 대상으로 하였으며, 연구의 방법은 관련 법령, 문헌의 조사 및 검토, 현재 제조업 및 건설업 안전관계자의 인터뷰 등으로 수행 하였다. 연구결과, 용어의 개념 정리, 강풍에 의한 양중기 안전, 차량계 건설기계 헤드가드, 경사로 미끄럼 방지 조치, 울, 덮개 설치 기준에서 개선사항을 확인 하였다. 개선 사항은 법 적용에 있어, 수검자는 구체적인 기준이 제시되지 않으면 강제성이 있는 법의 특성상 죄형법정주의 명확성의 원칙이 보장되지 않으므로 법 적용의 다툼이 있을 수 있고, 사업장 안전관리에 혼선과 불신이 초래된다. 타법과의 형평성 있는 적용 및 이에 대한 개선으로 산업안전보건기준에 관한 규칙은 명확하고, 신뢰성이 확보될 수 있도록 법 개정이 필요하다.

영문 초록

Since the Industrial Safety and Health Act was enacted in December 1981, it has been completely revised in January 1990 and promulgated in October 2018, which is 28 years old. The purpose of the Industrial Safety and Health Law is to maintain and promote the safety and health of workers who provide labor by establishing industrial safety and health standards and clarifying the cause of their responsibilities, thereby preventing industrial accidents and creating a pleasant working environment(Article 1 of the Act). The details required by the Act are detailed in the Regulations on Occupational Safety and Health Standards, of which Part 2, Safety Standards, Chapter 1, Machinery, Equipment, and Hazard Prevention The research method was conducted by investigating and reviewing related laws and documents, and interviewing the safety officials of the manufacturing and construction safety authorities. As a result of the study, the improvement was confirmed in concept of terminology, middle and long term safety by strong wind, head guards of construction equipment for vehicles, slip prevention measures for ramps, and wool and cover installation standards. In the case of the application of the law, in case of the application of the law, unless the specific standard is provided, the principle of clarity of the criminal statutory principle can not be guaranteed due to the nature of the compulsory law, so there may be a dispute on the application of the law, do. As a result of equitable application with other laws and improvements, it is necessary to revise the rules on industrial safety and health standards to be clear and reliable.
