국문 초록

임차인의 보증금은 재산에서 큰 비중을 차지한다. 주택임대차보호법을 제정 또는 개정하고 있지만 여전히 많은 임대차 보증금과 관련하여 수많은 소송들이 제기되고 있는 현실이다. 주택의 인도와 전입신고를 하면 대항력이 발생하고, 대항요건과 확정일자를 받으면 우선변제권이 생기는데, 대항력의 효력은 전입신고한 날의 다음날부터 발생하고 다른 채권자가 근저당 등기를 하면 등기한 날에 효력이 발생하므로 임차인은 후순위에 밀려서 임차보증금에 대한 손해가 발생하고 회수가 힘들다는 점이 있다. 현재, 전국의 주택임대료가 계속 상승하면서 임차인의 주거비 부담이 커지고 있는데, 현실적 실효성이 문제가 되는 최우선 변제금 범위를 현재 시장가격에 맞추어 조정하여야 할 것이며, 임차인의 임차보증금 한도는 매매가격 대비 전세가율의 범위 내에서 저당권 등의 선순위 채권액을 포함하여 최대한도를 결정하여야 한다. 일정한 요건을 갖춘 임차인에게도 등기권자와 동일하게 경매신청권을 즉시 부여하고 소송에 대한 번거로운 절차를 해결하므로 보증금을 빠르게 회수 할 수 있도록 개선하여야 한다. 현재, 주택도시보증공사에서 시행하고 있는 임대보증금 보증가입 안내 및 전세보증금반환보증 보증가입 안내에 대한 홍보가 미흡하여 정부 차원에서의 지속적인 홍보가 필요하다.

영문 초록

Deposits for tenants account for a large portion of the property. Although the Housing Lease Protection Act is being redefined or revised, numerous lawsuits are still being filed regarding many lease deposits. The delivery of a house and the move-in report give rise to counter-force, and when the counter-requirements and fixed dates are received, the counter-force effect occurs the day after the transfer is reported, and when another creditor registers a mortgage, the tenant is pushed to the back and the lease deposit is hard to recover. Currently, the burden of housing costs for tenants is increasing as housing rents continue to rise across the country, and the scope of the lease deposit, which is problematic in reality, should be adjusted to match the current market price, and the maximum value of the tenant s lease deposit, including mortgage, should be determined within the range of the lease price. Tenants who meet certain requirements shall be immediately granted the same right to apply for an auction as the registered person, and the proceedings for litigation shall be resolved, so that the deposit can be recovered quickly. A guide to the purchase of a lease deposit guarantee currently being implemented by the Housing &Urban Guarantee Corporation; Due to the lack of publicity about the registration of guarantees for the return of jeonse deposits, the government has continued to do so. It needs publicity.
