우루과이 직접민주주의 제도의작동과 정치적 효과

국문 초록

이 글은 대의민주주의 체제 안에서 직접민주주의가 지속적으로 조화롭게 작동할 수 있는가능성을 고찰하는데 목적을 두고 있다. 직접민주주의가 대의민주주의를 보완하는 기제로작동할 수 있다는 주장에도 불구하고, 직접민주주의는 정당 및 의회 약화, 시민들의 전문성과심의 부족, 이익단체 개입, 여론조작, 다수에 의한 횡포와 같은 문제점을 지적받아왔다. 우루과이는 1917년 국가 차원에서 국민발안과 국민투표를 제도화하였으며, 아래로부터의 직접민주주의를 실현하고 있다. 상당수의 국가가 직접민주주의 제도를 도입하였지만 국민투표를 드물게시행하거나 정부 주도의 국민투표인 경우가 많다. 그러나 우루과이의 직접민주주의는 시민발안에 의한 국민투표다. 시민들이 참여하고 다른 정치행위자들과 연대하며 심의하는 과정을통해 입법과정에 참여하는 것이다. 시민발의를 제안하고 국민투표 단계에 이르기까지 몇년의 시간이 소요되더라도 시간이나 결과보다는 참여에 의미를 둔다. 우루과이의 직접민주주의는 정당 및 의회 약화, 시민들의 전문성과 심의 부족, 이익단체 개입, 여론조작, 다수에 의한횡포와 같은 문제점은 나타나지 않았으며, 높은 단계의 정치제도화와 성숙한 시민의 정치참여를 통해 대의민주주의의 보완재로써 그 역할을 하고 있다.

영문 초록

The purpose of this paper is to examine the possibility whether direct democracy and representative democracy can work in harmony and continuity. Despite the claim that direct democracy can function as a complementary mechanism to representative democracy, direct democracy points out problems, such as, weakening political parties and legislation, lack of expertise and deliberation of citizens, interest group intervention, manipulation of public opinion, and tyranny by majority. In 1917, Uruguay institutionalized popular initiatives and plebiscite/referendum at the national level and realizes direct democracy from the bottom-up. Many countries have introduced direct democracy, but they rarely implement plebiscite or government-led plebiscite. Uruguay s direct democracy, however, is a bottom-up referendum. That is, participation in the legislative process through the process of citizen participation and consensus with other political actors. Even if it takes years to propose citizen initiatives and reach the referendum stage, participation is deemed more important than time or results. Uruguay s direct democracy did not show problems such as political party and parliamentary weakness, lack of expertise and deliberation of citizens, interest group intervention, public opinion manipulation, and tyranny by majority. It serves as a complement to democracy
