국문 초록

본 연구는 건국헌법 농지개혁 조항의 규범적 기원과 그 정치적 현실에 미군정이 미친 영향을 탐구하는 것이다. 건국헌법 농지개혁 조항은 ‘농지는 농민에게 분배한다’는 정치적 규범을 결단하였을 뿐 그 정치적 현실은 이후의 정치과정으로 유보되었다. 정치 또는 법학 분야의 많은 연구자들은 건국헌법의 농지개혁 조항이 이승만의 정치적 결단이었으며 한국의 자본주의적 산업발전의 토대가 되었다고 주장함으로써 미군정의 영향력을 과소평가해왔다. 그러나 해방 이후 건국 전까지 정치적 통치자로써 미군정은 농지개혁 문제가 좌우 및 중간파 정치세력의 중요한 정치적 의제로 다루어지는 가운데 (1) 농지개혁과 관련한 다양한 정치적 주장을 구체화된 법률적 형태로 제도화 하였고, (2) 매수매상의 방법과 대상, 소유권에 대한 논쟁을 종결지었으며, (3) 농지개혁 과제를 건국 정부의 정치적 의제화 함으로써 농지개혁 규범의 형성과 실행에 중대한 영향을 미쳤다. 유보된 규범으로서 건국헌법 농지조항의 현실 규정력은 미군정에 의해 사전적으로 결정되었던 것이다.

영문 초록

This study is to explore the role of the US Military government on normative origin and its political realities of the farmland reform article of 1948 founding constitution of Republic of Korea. The 86th article of the constitution only decided political norm that farmland would be distributed to famers and its political reality depended on political process aftermath. Many scholars in the field of politics and law have proclaimed that the 86th article was President Rhee Syngman’s political decision and milestone of Korean capitalistic development so they have underestimated influence of the US military government. After the independent form Japanese colonial rule in 1945, however, farmland reform was one of very important political agendas among right, left and middle political groups. And US military government made an important effect on formation of norm and execution of farmland reform by (1) institutionalizing principle of farmland reform, (2) terminating various political contentions on property right, scope and method of the farmland reform, and (3) making farmland reform for imminent political agenda. US military government pre-decided realities of farmland reform article of 1948 founding constitution as a reserved norm.
