국문 초록

대법원이 2016. 8. 17. 선고 2014다235080 판결(“로앤비 사건”)에서 일반적으로 접근 가능한 개인정보, 즉 공개된 개인정보의 이용에 대하여 획기적인 판결을 선고한 이래 이 문제에 대하여 여러 논의가 있었다. 그러나 이른바 데이터3법 개정과정에서는 이 문제가 별로 주목을 끌지 못한 채 신용정보법 제15조 제2항 제2호 다.목에 판례를 입법화한 규정이 추가되는 데 그쳤다. 이 글은 일반적으로 접근 가능한 개인정보의 처리가 한편으로는 정보자유, 다른 한편으로는 정보보호가 충돌하는 문제영역임을 보이고, 그에 관한 올바른 이익형량의 방법을 제시함과 동시에, 현행 개인정보 보호법의 해석으로는 이 문제를 적절하게 처리할 수 없다는 점을 밝힌다. 이 점은 로앤비 사건판결과 개정 신용정보법 제15조 제2항 제2호 다.목의 동의 구성도 다르지 아니하다. 그리고 그러한 문제의 해결책으로 일반적으로 접근 가능한 개인정보를 범주적으로 예외로 다루기보다는 개인정보 보호법 제15조 제1항 제6호의 이익형량 규정을 좀 더 유연하게 개정하는 방법이 낫고, 비교법적으로도 지지를 받는 방법임을 주장한다.

영문 초록

Since the Supreme Court of Korea took a position on processing publicly available personal information in a landmark decision on August 17. 2016, docket number 2014Da235080 (“LAWnB”), there have been many analyses and debates on this issue. It seems, however, to have attracted little interest of the legislator during the procedure for the so-called revision of data-law-triad, so that only the revised Credit Information Act of 2020 accommodated a new provision for it following the LAWnB ruling, which stipulates the personal information, the holder thereof made publicly available via SNS et al., can be collected and processed within which one could objectively see the holder consent to be processed. In this paper, the author endeavors to show that the issue of processing publicly available personal information is a balancing of the conflicting interests, informational freedom on the one hand and informational privacy on the other, and further elaborated a criteria for the rightful balancing of these interests. In addition, it demonstrates that the current regime of Personal Information Protection Act, even the revised Act of 2020, cannot address this issue properly. Lastly, it argues that a revision of legal basis of processing of the article 15 section 1 number 6 into a balancing test more flexible and slightly favoring information freedom would be the best solution for this problem lege ferenda.
