대한민국의 탄생과 공화주의 실현의 과제

국문 초록

최근 우리 사회에서 점차 화두가 되고 있는 공화주의라는 개념어에도 불구하고, 이것이 의미하는 바가 무엇인지에 대해서는 논란이 많고, 학술적으로 분명히 정립되지 못하고 있다. 이 글은 공화주의의 전개와 민주공화국의 의의와 내용 검토를 통해 세계화 시대에 부응하는 민주공화국의 방향성 정립을 모색하기 위한 시론적인 접근이다. 이 글은 대한민국 헌법 제1조 1항에 기술된 ‘민주공화국’의 현재적 의미에 대한 본격적인 논의가 부재하다는 문제의식에서 출발하여, ‘민주공화국’의 연혁 검토를 통해 현재적 의미를 민주주의와 공화주의의 결합에서 찾고, 민주주의의 일반적 조건을 충족시키면서 동시에 자유주의와 공화주의의 핵심원칙을 포용할 수 있는 ‘민주공화국’의 가능한 현재적 방안을 제시하는 것을 목적으로 한다. 필자는 민주공화국의 틀 안에서 제도개혁을 영속적으로 수행하려는 정치적 입장을 역동적 공화주의로 정의한다. 한국사회에서 민주공화국이 사회개혁의 엔진이 되기 위해서는 냉전적 자유주의로 고착된 정치체제를 경합적 다원주의로 변형해야 한다. 정치의 영역에서는 대의제의 기본 틀에서 직접민주제를 강화하고, 시민참여를 통하여 엘리트 정치구조를 견제하자고 제안한다. 다음으로 경제의 영역에서는 세금과 이전지출을 통한 사회민주적 방안 대신에 역량강화의 정치를 제안하고 있다. 민주공화국의 참된 의미를 실현하기 위해서 민주주의와 공화주의를 동시에 실현하는 것이 100년 전 임시정부의 헌장을 만들었던 선조들의 뜻이고, 현재를 살아가는 우리들의 과제일 것이다.

영문 초록

Despite the concept of republicanism, which is becoming a hot topic in our society recently, there is a lot of controversy about what this means, and it is not clearly established in academic terms. the purpose of this article is to explore the direction of the democratic republic in response to the birth of global citizens in the era of globalization. This paper aims to offer an account of ‘democratic republic’ documented in the first article of the South Korean Constitution, by setting forth the course of reasonable deliberation that brings classical republicanism back into touch with democracy in our political and constitutional practices. Although there are many references to the set of constitutional principles that we find compelling, very few scholarly attempts have been made to explore the other values - that is, republican values - which are just as much a part of the constitution as are liberal values. Failure to explore the other political values in the constitution will leave us with a distorted image of the character of democratic republic. The aim of this article is to unfold dynamic republicanism as the direction to perpetually carry out institutional reform within the frame of a democratic republic. The Republic of Korea as a democratic republic should overcome the Cold War liberalism so as to become a platform for the social reform. Next, this paper suggests the basic policies of the democratic republic based upon the liberal socialist visions of the Roberto Unger, Chantal Mouffe and Zhiyuan Cui. In the area of politics, it is absolutely necessary to strengthen direct democracy for supplementing the representative system. Considering constitutional court and legislative process, Citizen’s Constitutional Jury or Citizen’s Model Assembly will efficiently check the juristocracy or the political class and speed up politics. In the economy, state interventions and adjustments are permanently necessary for enhancing capability of ordinary people.
