가축 폐사체 관리의 법적 현황 분석 및 정책 제언

국문 초록

우리나라에서 통상적으로 발생하는 가축 폐사체의 대한 관리 규정은 「폐기물관리법」을 근거로 한다. 그러나 축산농가에서 가축 폐사체 발생 시 폐사체의 농가 내 보관, 이송 및 최종 처리 등과 같은 일련의 절차는 일반적인 폐기물의 관리기준과 맞지 않은 측면이 있다. 따라서 폐사체의 효율적인 관리를 위해서는 먼저 정부와 지자체의 「폐기물관리법」, 「가축전염병예방법」, 「비료관리법」, 「사료관리법」, 「동물보호법」, 「축산법」 등 관련 법률, 제도 및 행정을 일원화하는 틀의 제시가 필요하다. 우리나라에 실정에 맞는 폐사체 처리방법을 검토하기 위하여 그 발생에서부터 처리 및 통계･평가까지 8단계(가축 폐사체의 ①발생단계, ②신고단계, ③폐사체 보관단계, ④전염성확인검사 및 행정적 현장판단, ⑤행정적 현장판단 후 처리의 결정: 축산농가 자체 처리, ⑥행정적 현장판단 후 수거·이송 단계, ⑦위탁처리의 허가 및 수행 단계, ⑧최종처리신고 및 통계·평가 단계)로 분류하였다. 또한 이에 따른 검토 분야로써 「법률 및 행정」, 「지자체기관 및 축산농가」, 「정부 및 지자체 지원」을 구분하여 세부적인 현황을 진단하고 개선 방향을 제시하였다.

영문 초록

In Korea, general regulations on the management of livestock mortality are based on the “Wastes Control Act”. However, the management (storage, transport, treatment, final disposal, etc.) of livestock mortality in livestock farms does not meet the general waste management standards. Therefore, for the efficient management of livestock mortality, it is first necessary to establish a framework for unifying related system, administration and laws; Wastes Control Act, Act on The Prevention of Contagious Animal Diseases, Fertilizer Control Act, Control of Livestock and Fish Feed Act, Animal Protection Act, Livestock Industry Act, etc. In order to consider the management of livestock mortality, it was classified from the occurrence to the treatment, statistical and evaluation stages; (1) occurrence, (2) notify, (3) temporary storage, (4) infectious diseases check and administrative judgment, (5) determination of treatment method (livestock farmers), (6) collection and transfer, (7) consignment processing, (8) final disposal report, statistics, and evaluation. Further, detailed status (livestock farm, local government, central government, law, and administration) was diagnosed and improvement directions were presented.
