국문 초록

영국의 수사특별법원(IPT)은 수사권한규제법(RIPA)의 제정으로 2000년 10월부터 그 업무를 시작하게 되었다. 수사특별법원(IPT)은 제한된 권한을 가진 법정기관에 해당하며, 관할과 권한은 전적으로 수사권한규제법(RIPA)과 관련 법규에 의해 규정된다. 또한 수사특별법원(IPT)은 사건의 청구 또는 불만 사항을 접수함으로써 모든 권한을 행사할 수가 있다. 아울러 수사특별법원(IPT)의 업무수행 내용을 살펴보면, 정보 및 관련 문서의 내용이 영국의 공공 이익, 국가안보 침해, 중대범죄 예방 및 억제, 경제적 복지, 특정 정보기관의 지속적인 기능수행 등과 관련되어 있을 사안에 해당할 때에는 비공개로 진행하는 것을 원칙으로 운영하고 있다. 이와 관련된 내용은 수사특별법원(IPT)이 고소인 또는 다른 사람에게 공개하지 않을 수 있음을 의미하며, 수사특별법원(IPT)이 구두 청문회 개최 또는 개최할 것을 제안한 사실, 청문회 과정에서 제공한 비공개 문서 및 정보, 특정 증인의 신원, 참석자, 타인이 제공한 정보, 정부가 자체적으로 공개 금지한 정보 및 자료 등에 대해서는 공개가 금지되는 등 국내 안보전담 재판부가 없는 실정을 감안하면 시사점이 있어 보인다.

영문 초록

Investigatory Powers Tribunal (IPT) began its work in October 2000 under the enactment of the Regulation Investigatory Power Act (RIPA) in U.K. The IPT is a statutory body with limited jurisdiction, and its jurisdiction and authority are defined solely by the Regulation Investigatory Power Act (RIPA) and related laws and regulations. The IPT can also exercise all powers by filing a claim or complaint. In addition, the contents of the IPT work are as follows. The IPT operates in a private manner when the content of the information pertains to public interest in the UK, national security violations, prevention and suppression of serious crimes, economic well-being and the continued functioning of certain intelligence agencies. This means that the IPT may not disclose it to the complainant or others. Facts proposed by the IPT to hold oral hearings, non-public documents and information provided during the hearing process, the identity of certain witnesses, participants, information provided by others, and information and materials that the government has prohibited from disclosing itself. This suggests that there is no domestic security court in Korea.
