무인비행장치(드론)의 가시권 밖 비행을 위한 개선방안 연구

국문 초록

우리나라는 혁신적 기술의 산물인 드론의 활용을 위한 많은 투자와 연구를 진행해 왔으며, 드론 관련 규제완화 정책도 적극적으로 진행해 왔다. 가령, 2017년 3월 30일부터 기존의 항공법이 폐지되고, 항공 관련 규정을 항공안전법, 항공사업법 및 공항시설법으로 통합하였다. 이 중 항공안전법의 개정을 통해 舊항공법에서 금지되었던 드론의 야간 비행 및 가시권 밖 비행이 가능하게 되었다. 그러나 드론의 야간 비행 및 가시권 밖 비행은 추락사고가 발생될 수 있는 경우의 수가 많다. 이에 국민에게 발생될 수 있는 피해를 미연에 방지하기 위해 드론의 가시권 밖 비행의 허용에 관한 논의가 필요하다. 현재 드론의 가시권 밖 비행을 하기 위해선 「항공안전법 시행규칙」 제312조의2에 따라 무인비행장치 특별비행승인 신청서를 국토교통부장관에게 제출하여야 한다. 이후 드론의 안전한 비행을 위한 승인절차로서 「무인비행장치 특별비행을 위한 안전기준 및 승인절차에 관한 기준」에 따라 몇몇 사항의 검증을 받게 된다. 일련의 절차를 거친 후에 승인을 받은 민간 업체는 「무인비행장치 특별비행을 위한 안전기준 및 승인절차에 관한 기준」을 준수해야 한다. 구체적으로 지침의 별표 4 특별비행 안전기준 중 비가시 비행 시의 준수사항을 이행해야 한다. 이 글에서는 드론의 안전한 가시권 밖 비행을 위하여 「무인비행장치 특별비행을 위한 안전기준 및 승인절차에 관한 기준」에 있어서 특별비행 안전기준의 개정 사항을 제시하였다. 구체적으로 첫째, 제3자의 출입 관리, 둘째, 유인항공기의 충돌 감시, 셋째, 자기 감시와 조종자 주변의 기상 상황 모니터링을 대체하기 위해 필요한 기상장비나 지상 설비 등의 활용에 관한 계획을 수립할 것을 제시하였다.

영문 초록

Korea has pursued a lot of investment and research to utilize drone. And the Korean government has actively pursued drone-related deregulation policies. For example, since 2017, civil aeronautics law has been abolished and integrated into aviation safety act, aviation business law and airport facilities act. Among the relevant laws, the amendment of civil aeronautics law allowed drone s night flight banned by air law and out-of-flight in the visible range. However, a drone night flight and a visible flight outside flight can cause a crash accident. Therefore, in order to prevent the damage that can occur to the citizen in advance, it is necessary to discuss the drone s permission to fly outside of the visible range. In order to fly outside the visible range of the drone now, according to the enforcement regulations of aviation safety law, a special flight approval application form for the unmanned aerial vehicle shall be submitted to the government. Subsequently, as approval procedure for safe flight of drone, confirmation is made based on “Criteria for safety standards and approval procedures for special flight of unmanned aerial vehicles”. Among the contents concerning this guideline, the drone pilot must fulfill “compliance matter of macroscopic flight cities within special flight safety standards”. In this research, I presented revised items of special flight safety standards in “Criteria for safety standards and approval procedures for special flight of unmanned aerial vehicles” for drone s outer flight in the safe visible sphere. Specifically, it is about contents relating to management of entry and exit of a third party. And secondly, it is an improvement point of collision monitoring of manned aircraft. Thirdly, I proposed a plan to develop self-monitoring and plan for utilizing weather observation equipment and ground facilities necessary for replacing the weather condition around the pilot with surveillance.
