국문 초록

현대국가에서는 ‘관에서 민’으로, ‘작은 정부’의 구호 하에서 지금까지 행정이 담당한 임무를 민간에 위탁하려는 시도가 진행되었고, 그 시도는 외압을 주된 유인으로 하는 규제완화를 수반하는 것이었다. 현대국가의 역할은 거대한 국가의 인적·물적 자원을 가지고도 담당할 수 없을 정도로 지나치게 확대되고 있다. 그리하여 공권력·공익의 담당자의 확대와 동시에 공공적 과제의 처리 및 서비스질의 담보는 행정법의 새로운 임무로 되었다. 그러나 국가의 인적·물적 자원에는 한계가 있어 국가재정이 고갈되는 현상에서는 가능한 것과 가능하지 않는 것에 대한 적절한 임무의 선별이 요청된다. 국가의 역할은 공익사업의 사화가 행하여진 이후에도 결코 끝나지 않았다고 할 수 있다. 국가는 일찍이 스스로 공익사업을 수행하던 단계에서 그 역할을 변화시켜 공익사업의 실시를 위임받은 민간주체가 그 사업을 적절하게 실시하는가에 관하여 지시·감독하는 새로운 역할을 담당하고 있기 때문이다. 이러한 새로운 역할수단을 보장행정이라고 한다. 보장행정은 시장경제에 대한 규정·제어의 작용이고 보장행정의 핵심은 규정된 자기규정의 개념이다. 본고에서는 국가가 담당하는 새로운 역할로 보장행정에 관한 개괄적 기초적 연구로서 보장행정의 등장, 보장행정의 기능과 특성, 보장행정의 전개, 보장책임의 이해, 보장행정의 전망 등을 검토하였다. 이와 관련하여 일본 板恒勝彦의 ｢保障行政의 法理論｣의 일부를 번역하고 정리하였다.

영문 초록

In modern countries, there have been attempts to entrust the duties of the administration from government offices to the private sector under the slogan of a small government. The attempt involved deregulation with external pressures as the main cause. The role of a modern nation is expanding too much to be handled with the human and physical resources of a huge nation. Thus, the handling of public tasks and the security of quality of service while expanding the number of people in charge of public power and public interest are new duties of the administrative law. However, the nation s human and physical resources are limited, and in a phenomenon where state finances are depleted, appropriate selection of tasks for what is possible and not possible is called on. The role of the state is never over even after the privatization of the public interest business. The state is in charge of directing and supervising the implementation of public works projects by changing its role in the stage of carrying out public works projects on its own earlier stages. This new means of role is called guaranteed administration. The guarantee administration is the function of regulations and controls on the market economy, and the core of the guarantee administration is the concept of prescribed self-regulation. This paper examines the emergence of security administration, the functions and characteristics of the security administration, the development of the security administration, the introductory understanding of the security responsibilities, and the prospects of the security administration. In this regard, I translated and summarized the Law Theory of Security Administration, which it was written by Hikatsuhiko Itanohiko.
