국문 초록

우리나라는 남북한 분단 이후 70년이 넘는 기간 동안 법·사회·정치·경제 분야에서 서로 다른 제도가 발전해왔다. 특히 남한과 북한이 각각 자본주의와 사회주의 부동산 소유제도를 확립 및 발전시킴에 따라 오늘날 양 제도 사이에는 현저한 간격이 존재한다. 통일 시 이러한 차이는 양 제도를 통합하는 데 걸림돌로 작용할 수밖에 없다. 이런 문제를 완화하고 수월한 통합을 준비하기 위해서는 선행적으로 남북한 부동산소유제도의 차이를 그 뿌리부터 깊이 있게 이해할 필요가 있다. 그러므로 이 글은 자본주의와 사회주의 법제에서 사용하는부동산개념을검토하고, 개인이 토지와 주택 등의 건물에 대해서 향유하는 권리를 심도있게 연구하기로 한다. 특히 부동산 소유제도의 근저를 이루는 기본원칙과 각 법제에서 부동산소유권과 이에 준하는 권리가 갖는 특색을 분석하기로 한다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this research is to examine disparities between capitalist and socialist institutions with respect to ownership of immovable property. By studying the concept of immovable property and the underlying principles of ownership of immovable property in capitalist and socialist legal systems, it becomes possible to better understand the fundamental differences between the jurisdictions of South and North Korea. (2) Research method This research was carried out by conducting a legal analysis of capitalist and socialist academic writings and legislative texts. Korean and Russian literature was referenced for this research. (3) Research findings The research reveals the vast differences in the nature and scope of ownership of immovable property between the capitalist and socialist legal systems. 2. Results The results of the research are three-fold. First, the concept ‘immovable property’ although used in both capitalist and socialist legal systems, carries different meaning. Whereas in the former the concept contains land, in the latter land is in principle absent, with the concept mainly synonymous with building. Second, In capitalist legal systems, ownership of immovable property is unitary, regardless of the subject of ownership. In comparison, in socialist legal systems ownership of immovable property is differentiated depending on the subject of ownership. The state enjoys the full spectrum of rights, whereas ownership of individuals is considerably restricted. Finally, in capitalist jurisdictions, individuals are at liberty to own land and houses free. The source of law for regulating immovable property is in principle singular. In socialist jurisdictions, the state has a monopoly over land, with individuals having the right to own in principle one house.
