국문 초록

이 연구는 보험소비자 불만을 중립적이고 공정한 입장에서 원만히 조정해 당사자 간 신뢰를 쌓고 불필요한 사회적 비용 발생을 줄여나가고 있는 일본의 보험 ADR(Alternative Dispute Resolution) 운영 체제와 정착 과정을 일본 손해보험업계를 중심으로 추적하였다. 특히, 보험 ADR 시행의 도화선이었던 금융 분야 ADR 도입과 제도 설계 과정을 살펴 일본의 보험 불만과 분쟁처리 체계 개혁이 어떠한 과정을 거쳐 이루어졌는지를 되짚어 보았다. 본래 보험 불만은 사전 불만 요인 발생을 차단하는 것이 중요하지만, 제기된 불만을 신속하고 합리적으로 해결하는 것이 보험경영 나아가 보험업의 사회적 신뢰 제고 차원에서 보다 긴요하다. 이러한 시각에서 보험 불만과 분쟁을 신속하고, 효율적으로 그리고 무엇보다 보험소비자와 보험회사 모두의 납득을 중요시하는 보험 ADR 체제를 정착시킨 일본의 사례는 우리에게 시사하는 바가 크다.

영문 초록

This study is concerned with Alternative Dispute Resolution(ADR) for insurance disputes of Japan, which is building trust between parties and reducing unnecessary social costs by amicable coordinating of insurance consumer complaints from a neutral and fair standpoint. In particular, this study tracked how insurance complaints and dispute settlement system were reformed in Japan, with attention directed to the background and process of designing the financial ADR system, which was the trigger for the implementation of the insurance ADR. Complaints need to be prevented in advance. However, it is no less dubious to connect that resolving complaints quickly and rationally is very important in the management and trust of insurance companies. In this regard, the case of Japan, which has settled insurance complaints and disputes quickly and efficiently through the Insurance ADR, and above all, a solution acceptable to both consumers and insurance companies, has much to suggest to us.
