권원(權原)없이 점유한 토지의 실태조사와 재정확보를 위한 입법론적 연구

국문 초록

국방부가 전국에 여의도 면적(280만㎡)의 8배 이상 사유지 약 2,542만㎡(공시지가;약4,620억 원)를 권원(權原) 없이 무단으로 점유하고 있는 것과 이 사실을 토지소유자에게 제대로 통보하지 않은 것이 국정감사 과정에서 드러났다. 이에 대해 본 연구에서는 군용지 근거와 특성, 무단점유의 개념, 법적 책임과 한계, 해외사례 등 을 통해 입법적 측면에서 개정안을 제시하고자 한다. 개정안으로는 무단점유지 보상에 필요한 재원을 확보할 수 있도록 국방군사시설이전특별회계법(‘특별회계법’) 제4조(세입) 일부를 개정하고 국방부가 무단점유 실태를 파악 후 토지소유자에게 알릴 수 있도록 국방·군사시설사업에관한법률(‘군사시설사업법’) 제14조 2 (실태조사 등)을 신설하여 정기적으로 조사할 것을 제안한다. 국민의 재산권 보장은 민주주의 시장경제의 기본 이념이며, 헌법상 보장된 권리에 해당한다. 따라서 무단점유지에 대한 정기적인 실태조사 등의 조치는 국민의 재산권 보호의 첫걸음이라고 할 수 있다. 이 제안은 2019.4.5 본회의 의결을 거쳐 시행하게 되었다. 그러나 향후 실태조사 뿐만 아니라 실질적 보상이 이루어질 수 있도록 재원확보를 위한 다각적인 노력이 함께 요구된다.

영문 초록

The National Assembly pointed out that the government (Ministry of National Defense) illegally occupies approximately 25.42 million ㎡ (officially declared land price : approximately 462 billion KRW) of private land, which is 8 times the area of Yeouido (2.8 million ㎡), and did not inform the landowner of the fact, infringing the property right of people. This study is intended to present improvements such as the basis and characteristics of military reservation, the concept of illegal occupation and legal responsibilities and limit, and foreign case studies in order to resolve illegal occupation based on the contents of a parliamentary inspection of government offices. Proposed improvements include the partial revision of Article 4 (Revenue) of the Act on Special Accounts for Relocation of National Defense and Military Installations to secure funds required for compensation for illegally occupied land. As well, it was proposed to newly establish Article 14-2 (Fact-finding, Etc.) of the Act on National Defense and Military Installations Projects to ensure that the Ministry of National Defense can determine the current status of its illegal occupations and inform the affected landowners. This new establishment was executed after the decision of a plenary session on April 5, 2019. Guarantee of property rights is a basic concept of a democratic market economy and is a right guaranteed by the Constitution. As such, in addition to guaranteeing property rights, enhancements to transparency such as fact-finding, etc. can be applied and developed into various areas such as the national land policy and taxation system. As such, follow-up studies in this area should be continued.
