한·일 양국의 제3차 범죄피해자 기본계획의 비교 연구

국문 초록

본 논문의 목적은 한일 양국의 제3차 범죄피해자 보호·지원 기본계획을 형식과 내용 측면에서 비교 검토하여 상호 이해도를 높이고 제4차 기본계획 수립을 위한 약간의 시사점을 얻는 것이다. 양국은 근본적으로 사고방식과 사회 환경 등이 전혀 달라 기본계획의 중심도 우리나라는 법무부(검찰)과 지원센터이고 일본은 경찰과 지자체이며, 우리나라는 매번 계획마다 중점 사항이 변화하나 일본은 기존 정책을 심화시키는 형태로 계획을 책정하고 있다. 우리나라는 형식적으로는 피해자를 위한 거의 모든 제도를 망라하여 앞으로는 실효성 제고에 좀 더 힘써야 할 것으로 보이고, 특히 형사조정은 회복적 사법의 시대 흐름에 부합하고 피해회복 및 관계회복 등에 크게 기여하고 있어 높이 평가할 만하다. 일본은 범정부 차원의 기본계획 수립을 위해 전문위원등회의 등을 적극 활용하여 관계부처의 참여를 높이고, 피해자가 정책 내용까지 제시하는 쌍방향 소통을 하고 있다. 또한 피해회복을 위한 손해배상명령제도와 공판에서 피해자에게 일정한 지위를 부여하는 피해자참가제도를 시행하고 있는데, 해외의 사례를 참조하면서도 자국의 환경에 맞는 독특한 제도를 만들어 낸 것은 시사하는 바가 있다. 아울러 해외에서 범죄피해를 당한 자국민에게 위로금을 지급하는 법률을 제정·시행하는 점도 참고할 필요가 있다. 피해자지원 정책이 기존의 형사정책 접근에서 사회복지 접근으로 확대됨에 따라 피해자와 근접한 곳에서 다양한 복지지원이 가능한 지자체가 조례 제정, 계획책정 등 다양한 활동을 벌이고 있는 점도 벤치마킹할 필요가 있다. 마지막으로 관련 직원의 장기간 근무 등을 통한 전문성 축적도 매우 중요하다.

영문 초록

Korea and Japan have prepared a big framework to support victims through three different iterations of a basic plan for crime victims and have achieved considerable results. The purpose of this paper is to compare and review the basic plans of the two countries to improve understanding of their bilateral system and to generate a few recommendations for the establishment of the fourth basic plan. Although the basic plans of the two countries seem similar in form and content, the practical contents and operational statuses are very different. Firstly, our analysis shows that the governments need to engage the participation of related ministries. To establish a pan-governmental comprehensive measure, the protection committee and the professional committee, like Japan, should be activated to establish itself as part of the national strategy. In particular, it is necessary to strengthen the role of the police who are the first to encounter the victims. Secondly, to address the damages effectively, it is necessary to refer to Japan s compensation order system, victim compensation system, and recovery payment system. Thirdly, it is necessary to review the introduction of the system of victim participation into criminal trials. Japan s system of victim participation was highly controversial at the time of its introduction, but is now considered to have been settled, and it is necessary to refer to its current state of operation. Fourthly, to provide welfare support to the victims, the role of local governments should be strengthened. It is necessary to benchmark Japan s ordinances, plans, and specific activities. Lastly, the development of expertise through the long-term work of related employees is a basic element in the establishment of basic plan. It is this researcher s wish that both countries will establish and implement an original fourth basic plan suitable for the circumstances of each country through various exchanges and communications.
