드론의 민간경비 활용과 문제점 검토

국문 초록

드론을 민간경비에 활용하기 위해서는 해결해야 할 문제들이 상존하고 있다. 물론, 드론을 통해 업무의 편리성과 경제성이 더 높아지고, 위험한 업무에 드론을 투입하여 인명피해의 위험성을 낮출 수 있는 성과도 예상된다. 그러나 이면에는 드론의 기술적 한계를 보완해야 하거나 법률적 문제 등의 나타날 것으로 생각된다. 이러한 문제를 해결하기 위해서는 일정부분 사회적인 합의도 필요한 시점이다. 이 연구에서는 이러한 문제를 해결하기 위해서 다음과 같은 내용으로 논의를 진행하였다. 첫째, 드론의 이해를 돕기 위해 개념의 정립을 시도하였다. 논의한 바에 의하면 드론이라는 용어는 법률적인 용어라고는 할 수 없다. 항공법에 의해 150kg 이하의 무인비행기를 드론이라고 간주하고 있지만 개념상 명시적인 규정으로는 볼 수 없다. 그리고 드론의 대중화로인해 다양한 종류의 드론들이 존재한다. 이러한 드론을 크기, 비행가능고도, 운용의 목적, 비행가능 거리로 구분하여 설명하였다. 드론의 무분별한 비행으로 인한 사고 발생을 방지하기 위한 비행금지 구역에 대한 법률적인 내용들을 파악하였다. 둘째, 드론의 민간경비 활용사례와미래에 활용 가능한 드론의 기능들을 제안해 보았다. 민간경비 분야에서 드론이 보편적으로 사용되고 있지는 않지만, 몇몇 경비회사 및 경비장비 회사 등에서 경비드론을 개발한 사례가 있다. 마지막으로 이연구의 핵심이 될 수 있는 민간경비 업무에 드론을 활용함에 따라 나타날 수 있는 법률적 문제, 사생활침해 문제, 드론을 이용한 범죄 문제, 사고 등으로 인한 안전상의 문제, 조종자의 자격 요건 등의 문제점들을 제시하였다.

영문 초록

There are lots of problems to be solved in order to use drones in the private security. Of course, through the use of drones, it is expected that not only the business conveniences as well as economic efficiency will be increased but the risks of casualties can be decreased by putting drones in the dangerous tasks. However, what lies behind is the technical limits and legal issues related to the use of drones. To solve this issues, a social consensus is also required in certain parts. In this study, in order to solve these problems, we have discussed the following contents. First, we tried to establish the concept of the drone to better understand it. According to the discussion, the word drone do not constitute a legal terminology. Though the Aviation Act regards the Unmanned Aerial Vehicles under 150kg as the drone, it can t be seen as conceptually explicit regulation. Also, due to the spread of the drones, there are various types of drones. We have classified these drones by their size, flight altitude, the purpose of the operation, and flight distance. We identified the legal matters about the no-fly zone established to prevent the accidents caused by the indiscreet use of drones. Secondly, we suggested the functions of the drones that can be utilized in the future as well as the use cases of drones in the private security. Though the drones are not commonly used in the private security area, there are few cases where some security companies and manufacturers developed the security drones. Lastly, we presented the legal and invasion of privacy issues that can arise due to the use of drones in the field of private security, crimes using drones, safety issues due to accidents, and qualification of the operator.
