국문 초록

노인인구의 증가에 따라 우리사회는 다양한 노인문제와 직면하게 되었고, 이러한 문제를 사전에 예방하고 대응방안을 마련하기 보다는 문제가 발생할 때마다 새로운 정책을 내세우고 해결하기에 급급한 실정이다. 노인인구의 증가가 노인범죄의 증가로 이어지는 것은 당연한 논리이며, 노인범죄에 대한 심각성을 인식조차 하지 못한 채 단지 그들을 사회적 약자로서 보호해야 되는 계층으로 판단하고 있는 게 큰 문제이다. 그동안 발생된 노인범죄를 보면서 국가와 국민들은 처벌위주의 대응만을 하여 왔으며, 이들이 범죄로 나아가게 되는 원인과 배경 등 처해있는 상황에는 관심이 부족하였다. 또한 노인범죄자들에 대한 시설내에서의 치료나 연령 및 범죄유형에 따른 차별화 된 교정‧교화 프로그램도 이루어지지 않고 있다. 이제 우리는 이들이 저지른 범죄의 특성이나 범죄의 발생원인 등 다각적인 측면에서 분석하고 연구하여 연령에 따른 형사처벌의 차별화, 범죄 유형별 차별화된 형사제재, 재범위험성 평가를 통한 유형별 처우, 노인치료처분의 확대 등 다양한 형사정책을 모색해야 한다. 우리사회에서 이러한 노력을 통해 노인범죄를 방지할 수 있다면 노인범죄는 사라질 것이며 재사회화를 통해 이들은 남은 노후생활을 보다 의미 있게 영위해 갈 수 있을 것이다.

영문 초록

Due to the growing elderly population, Korean society is confronted with a variety of problems with the elderly. In fact, however, a new policy has constantly been formulated whenever such a problem takes place instead of trying to prevent it in advance or find a fundamental solution. It s quite natural that the growing elderly population is followed by an increase in crimes committed by elderly people. The problem is that they are just regarded as a socially disadvantaged class in need of care without being aware of the gravity of elderly crimes. Punishment is the major way for the nation and people to cope with elderly crimes that have occurred so far, and they pay little attention to what makes them commit a crime or what situation provokes them to do that. Moreover, no treatment is provided for elderly criminals, and no differentiated correction or educational programs tailored to their age or type of crime are offered, either. Now it s required to analyze and research the characteristics and causes of elderly crimes from various angles to seek diverse criminal policies such as differentiated criminal punishment by age, differentiated criminal sanctions by the type of crime, different treatment by the type of crime based on recidivism risk, and extended medical treatment. If these efforts are made in our society to prevent senior citizens from committing a crime, elderly crimes will disappear, and resocialization will enable elderly criminals to lead a more meaningful life for the rest of their days.
