제조물책임법의 문제점 및 입증책임에 관한 연구

국문 초록

최근 가습가살균기의 피해 사건 등 제조물의 결함으로 인한 소비자의 신체·생명에 중대한 위험을 초래하는 사건이 늘고 있고 이에 따라 재산상의 손해가 막대하다. 제조물책임법은 이를 예방하고 피해자 보호를 위해 제정된 법이지만, 산업의 고도화로 인하여 소비자와 제조업자간의 정보의 비대칭적 구조는 점차 심화되고 있고 이로 인해 소비자의 피해도 막심하여 현행 제조물책임법의 한계가 드러나고 있다. 특히 가습가살균기 사건을 계기로 제조물책임법의 개정이 이루어져, 징벌적 손해배상제도의 도입, 소비자의 입증책임 완화, 공급자에 대한 책임 가중 등의 내용을 명시적으로 규정하면서 제조물책임법의 실효성을 거두기 위한 노력이 이루어지고 있다. 그러나 여전히 그 실효성이 완전하지 않아 보완이 필요하다. 제조물의 결함 등으로 인한 피해는 다수의 소비자를 양성할 수 있고 그 재산적 피해뿐만 아니라 소비자의 생명·신체의 중대한 영향을 미칠 수 았다는 점을 고려하여 그 사전적인 예방과 발생한 피해의 적극적인 구제 절차의 확보가 절실히 필요하다. 이에 현행 제조물책임법의 주요 내용과 한계를 살펴보고, 집단소송제도의 도입, 징벌적 손해배상제도의 강화, 소비자분쟁조정제도의 개선, 제조물책임보험가입의 제한적 의무화 등의 개선방안을 검토하고자 한다.

영문 초록

Recently, including the decimation caused by humidifer sterilizer, the incidents that damaging on the customers health and lives caused by products defect have been increasing, which yields significant financial risk to customers. Although the Product Liability Law is enacted for preventing the accidents and preserving damaged customers, it has been proved that it still has the limitation because the unequal information hierarchy between customers and producers are increasingly intense, which leads serious damage to customers. In particular, since the Product Liability Law is amended after the humidifer sterilizer accidents occur, many trials for improving its effect has been increased by definitely mention the disciplines, such as the introduction of the punitive damage law, easening the customer s responsible warranty, and burdening the responsibility to the producers. Nevertheless, this law is still imperfect on its effect, which should be supplemented with additional laws. Considering that the damage caused by product s defect can pose perils to customers and not only it can cause financial damage, but also can cause significant health damage to customers, preventing accidents that caused by the defects of products and enacting laws for compensating to its victim are desperately needed. For this reason, this paper will investigate the main contents and its limitation of the Product Liability Law, and discuss about possible solutions for improving the law, including the introduction of class action principle, strengthening the pungitive damage law, enhancing the principle of alleviating consumer dispute, and making the signing up to the insurance on the product s warranty to be qualified mandatory.
