국문 초록

본 연구의 목적은 북한의 ‘외국인투자기업 로동규정’과 ‘외국인투자기업 로동법’을 비교, 양 법령에서 추구하는 북한의 외국인투자기업 노동복지에 대한 법적 동학을 추적하는 것이다. 분석결과, 양법령의 공통점과 차이점은 첫째, 근로소득은 공통점과 차이점이 거의 동일한 비중으로 존재한다. 둘째, 근로복지는 내용상 다수의 공통점이 있는 가운데에 확연한 차이점도 나타났다. 셋째, 사회보장은 공통점과 차이점이 동시에 나타난다. 외국인투자기업 노동복지 법제의 지속성은 첫째, 북한은 양 법령 제정의 시간적인 차이가 존재하지만 노동복지의 기본적인 골격을 유지하고자 하는 경향이 있다. 둘째, 외국인투자기업의 복지급여의 경우 10년 동안 새로운 현금급여나 현물급여 없이 기존과 거의 동일하다. 셋째, 사회문화시책기금과 문화후생기금과 같은 노동복지와 관련된 재정부담 주체는 기존과 같이 외국인투자기업이 부담한다. 변화는 첫째, 양 법령의 표현에 있어 후일 제정한 「외국인투자기업 로동법」이 「외국인투자기업 로동규정」에 비해 상대적으로 현대화되어 있다. 둘째, 이와 연장선상에서 「외국인투자기업 로동법」이 「외국인투자기업 로동규정」에 비해 내용과 진술 면에서 구체적이다. 셋째, 「외국인투자기업 로동법」에서 최저임금 적용을 천명하여 기존의 근로소득에 관한 작은 변화를 추구하고 있다.

영문 초록

The goal of the study is to track the legal dynamics on the labor welfare for North Korea s foreign-invested businesses by comparing the ‘North’s Regulations for Foreign- Invested Enterprises’ with the North’s Laws for the Enterprises’. As a result of the analysis, the differences and similarities between the two statutes are as following: First, income earned is almost equal in the proportion to the similarities and differences. Second, there is a stark difference in working welfare while there are a lot of similarities in content. Third, social security demonstrates both of the aspects. The sustainability of labor welfare legal system for the foreign-invested businesses may be summarized as follows: First, North Korea tends to maintain the basic framework of labor welfare, although there is a gap of time between the two statutes. Second, the welfare benefits of foreign-invested enterprises are almost the same as the previous ones for 10 years without new cash benefits or wages in kind. Third, foreign-invested businesses are responsible for the financial burden of labor welfare, such as the Social Culture Policy Fund and the Culture Welfare Fund. As for the change, first of all, the Laws for the Foreign-invested Enterprises is relatively modernized in its expression compared to the Regulations for the Enterprises. Second, in extension, the former is more specific in terms of content and statements compared to the latter. Third, under the Laws, the minimum wage application is declared to be applied, seeking a small change in the existing income of workers.
