국문 초록

2010년 1월 발효된 캘리포니아 학부모 학교 참여권 강화법 은 미국 교육개혁방안 중에서 가장 혁신적인 내용과 실현방식을 담고 있으며, 이 법에 따라 학부모는 객관적 평가기준에 미달한 학교에 대해 청원서명 절차를 거쳐 관할 교육구에 교육개혁을 요구할수 있다. 물론 이 법률은 학부모가 모든 학교를 청원대상으로 삼을 수 없게 가이드라인을 정해놓고 있지만, 미국 교육계에서 전무후무한 교육개혁법안이기 때문에 전국에서법률의 시행을 관심 있게 지켜보고 있으며, 일부 주에서는 이와 유사한 법률을 제정할계획이다. 실제, 2010년 12월 이 법률을 적용하여 학부모단체가 청원서를 관할 교육구에 제출하였다. 혁신적인 성격의 교육개혁법을 시행하면서 캘리포니아 교육계에서는 찬반의견이 첨예하게 갈리고 있다. 교사노조는 이 법률을 학부모노조로 비판하는 반면, 찬성측에서는 자녀를 우선적으로 생각하는 학부모에게 학교관여의 정당한 권리를 돌려주는 것이라고 주장한다. 앞으로 주교육위원회와 관할 교육구가 학부모가 청원한 학교의 교육개혁을 어떻게 시행하는지를 지켜보아야 하겠지만, 이 법률은 학부모의 학교관여를 강화시킨 것 뿐 아니라 교육개혁의 일 주체로서 학부모의 권리를 대폭 신장시켰다는 점에서 의의가 있다고 사료된다.

영문 초록

The Parent Empowerment Law connected to the Race to the Top program proposed by the U.S. Department of Education is an innovation in education reform recently passed into law in the State of California. This historic law allows parents at low-performing schools(as defined in the California School Code) to force a change in their school`s institutional structure via petition. If half the parents or legal guardians whose children enrolled in a failing public school sign a petition requesting reform of the school, the school must either shut down, become a charter school, or undergo one of two other types of reform. By empowering parents, the Parent Empowerment Law forces school districts to undertake dramatic changes and reforms that education bureaucracies, conflicting interest, and political overseers would otherwise oppose. This law is known as innovative and radical education reforms more than MPCP(Wisconsin), DCOSP(Washington, DC), and RTTT(Federal Government). Opponents including teachers union call the law the lynch mob provision and insist that it doesn`t help schools or parents. On the other hand supporters regard this law a natural rights of the parents who want to improve academic achievement of failing public schools. The Parent Empowerment Law which is a revolutionary shortcut is helping parents around California organize to end the cycle of dismal public schools and other states and cities including Chicago, Georgia, Indiana, Michigan, New Jersey, and Maryland are perking up their ears to the idea. Now the one petition that has been delivered, at McKinley Elementary School in Compton, LA is delayed by legal wrangling. This law has significant momentum in the history of education reforms as a state law which directly intensified the parental involvement and rights.
