대한제국의 꿈과 대한민국임시헌장의 제정 정신

국문 초록

대한국국제는 고종황제의 흠정헌법이다. 전제정치를 강화하고자 한 노력은 시대상황적으로 외세로부터 독립하려는 강한 의지의 표현이었다. 그러나 고종황제의 이러한 노력은 결국은 수포로 돌아갔다. 그 이유는 전제정치의 강화는 당시 한민족의 시대적 요구와는 부합하지 않았기 때문이다. 자주독립이라는 민족의 염원은 3･1독립선언을 계기로 민족의 자각으로 되었고 이는 임시정부의 수립으로 나타났다. 임시정부에서 제정한 최초의 헌법인 임시헌장은 10개조의 간략한 조문으로 구성되었지만, 대한민국 최초의 헌법이라는 점에서 대한민국헌정사에서 중요한 의미를 가진다. 우선 대한민국의 정체성을 민주공화국으로 확립하였다는 점은 헌정사상 특기할만하다. 또 여기에서는 조선과 대한제국 망국의 원인인 각종 차별의 철폐에 대한 한민족의 의지가 들어 있다는 점 그리고 종교적 다원주의가 갖는 헌법사적 의미에 주목하였다. 그리고 빼놓을 수 없는 것은 100년 전 임시헌장이 지향했던 인도와 정의라는 것은 현대의 세계시민성의 핵심가치임을 드러내고 있다는 점이다. 특히 이 논문에서는 임시헌장과 함께 공포된 선서문에 나타난 임시헌장이 기초로 하고 있는 정신적 가치에 대해서 주목하고 있다. 이 선서문에서는 3･1운동이 독립을 요구한 날이 아니라 독립을 선언한 날이라는 것, 국가의 정체성을 민국으로 하고 있다는 것, 3･1독립선언이 일어난 1919년을 민국의 원년으로 하고 있다는 것, 차별의 철폐가 한민족의 가장 주요한 가치라는 점을 드러내고 있다는 것, 종교적 다원주의를 읽어 낼 수 있다는 것, 국제평화에 대한 강한 의지를 드러내고 있다는 것 그리고 정의와 인도를 민족정신으로 함으로써 세계시민적 가치를 지향하고 있다는 것을 찾아 볼 수 있다. 이러한 정신은 오늘의 대한민국헌법의 정신적 기초가 되고 있다는 점을 명확히 인식하고 이를 계승하려는 노력이 필요하다. 이것이 오늘 임시헌법 100주년이 우리에게 주는 교훈이다.

영문 초록

National System Charter of Empire Dai Han is the Constitution made by Emperor Gojong. His efforts to strengthen the tyranny of politics have been a manifestation of a strong willingness to be independent from foreign powers. But the efforts of Emperor Gojong eventually ended in failure. The reason is that the strengthening of the imperial politics did not match the demand of the Korean people at that time. However, the desire of the nation which is independent from foreign powers became the consciousness of the people on the occasion of the declaration of independence of March 1, and made the provisional government be established. The first Constitution enacted by the provisional government has been configured with a brief 10 articles, but it has an important meaning in the history of constitution of Republic of Korea. The fact that the identity of the Republic of Korea as a democratic republic was established in this first provisional constitution is very remarkable. In addition, the focus is on the Korean people s will for the abolition of discrimination, which was the cause of the fall of the Korean Empire, and the meaning of the constitutional history of religious pluralism. And it is essential that humanism and justice for which the first provisional constitution had directed and defined 100 years ago are the very core values of the modern world citizenship. Especially, in this paper, we pay special attention to the mental values on which the provisional constitution is based, in the sense of the Korean People’s oath published with the provisional constitution. In this oath, the fact that the March 1 1919 was not the day when independence was demanded, but the day when it declared, that our national identity as democratic republic was established, that the abolition of discrimination was the most important value of the Korean people, that religious pluralism could be read from the text, that the constitution expressed a strong commitment to international peace, and that our people aimed to be the citizen of the world by declaring justice and humanism are our national spirit. We should clearly recognize the fact that it is the spiritual basis of today s Constitution of the Republic of Korea, and have to effort to succeed it. It is the lessons the 100th anniversary of the Provisional Constitution gives for us.
