국내 인권기본조례의 현황과 내용

국문 초록

현재 인권기본조례를 제정한 지방자치단체는 광주광역시를 시작으로 최근의 부산광역시까지 모두 8곳이다. 이들 지자체의 인권기본조례는 지자체의 독특한 제정배경을 가지고 있지만 내용면에서 일정한 표준유형을 발견할 수있었다. 본 연구에서는 우선 인권기본조례의 제정과정, 조례의 구성체계, 주된 내용, 제정 이후의 상황 등을 중심으로 살폈다. 특히 각 지자체가 인권기 본조례에 공통적으로 담고 있는 내용을 비교 분석해 공통점과 차이점을 도출할 수 있었다. 이를 바탕으로 얻을 수 있는 시사점은 다음과 같다. 첫째, 인권기본조례가 제정되는 과정을 살펴보면 시민사회의 적극적인 제정운동이 있었다는 점을알 수 있다. 인권조례운동은 인권기본조례의 실효성 있는 집행을 위해서도 필수적이라고 할 수 있다. 둘째, 인권기본조례에는 위원회 구성 시 지자체장으로부터 독립성 및 전문 성을 확보하려는 다양한 시도라든지, 인권교육에 관한 내용을 두고 있다든지, 또한 인권기본계획을 둘러싸고 절차적 정당성 및 시책반영을 확보하기 위한 조치 등을 고려해 보았을 때 다른 행정조례에서는 볼 수 없었던 많은 차별성을 갖는다고 할 수 있다. 셋째, 일부 조례에서는 국가기관조차 시도하지 못하거나, 제정에 실패했던 다양한 인권보장 및 증진에 관한 조치를 포함하고 있다. 이러한 조치들이 도입되어 제대로 된 기능을 수행하게 된다면 이후에 법률의 제정 및 개정에까지 영향을 줄 수 있을 것으로 보인다.

영문 초록

Now local governments to enact basic human rights are 8 places beginning with Gwangju up to recent Pusan. Basic human rights of local governments has a unique enacting background and a certain standard type in contents. This study is to look around establishment process, the configuration system of the ordinance, the main contents, the situation since enactment. I have done a comparative analysis of the contents which basic human rights of local governments has in common and drawn similarities and differences. Based on this, implications that can be obtained as follows: First, positive enactment movement of the civil society can be seen by looking enacted process of basic human rights ordinance. Human rights ordinance is necessary for an effective enforcement of basic human rights ordinance. Second, much distinction not found in other administrative ordinance can be seen considering that various attempts to secure the independence and expertise from mayors of local governments, the contents of human rights education, measures to secure procedural justice and policies reflection around basic plan for human rights when forming committee of basic human rights ordinance. Finally, some ordinance has the measures about a variety of safeguard for human rights and promoting human rights which evern state agencies do not try, or have failed to enact. The enactment of laws and amendments is expected to be affected later if these measures have been introduced and the functions have been performed properly.
