중소규모 공사에 대한 표준시장 단가 적용 관련 조례개정의 법적 타당성 및 정책제언

국문 초록

경기도는 현행 100억 미만 관급공사의 경우에 표준시장단가를 적용하려고 하였으나, 행안부 예규에서 100억 미만 공사의 경우 표준시장단가를 적용할 수 없도록 정하고 있다. 이에 대해 경기도는 행안부 예규는 지방계약법 등 상위법령을 위반한 것으로 이는 법적 근거 없이 지자체의 권한을 침해 하는 것이며, 행안부 예규와 상관없이 조례 등을 통해 표준시장단가 적용여부를 결정할 수 있다는 입장을 취하며 100억미만 관급공사도 표준시장단가를 적용할 수 있도록 조례개정안 입법예고하였 다. 이하에서는 경기도 지역건설산업 활성화 촉진 조례 개정안과 관련하여 해당 조례가 계약 법령및 행안부 예규와 맞지 않는 조례를 개정한 경우에 위법성 여부에 대하여 지방계약법 등 관련규정을 중심으로 검토하고 이에 대한 입법적 대안을 제시하도록 한다.

영문 초록

In Gyeonggi-do Province is trying to apply law of the new clause in ordinance by less than 10 billion of construction. But By an established rule of Ministry of the Interior and Safety cannot be applied unit price of standard in the 10 billion of construction. All contracts, including those governing construction projects, require the stated parties to perform the work required by those contracts themselves. In the United States, public construction projects state that the main contractor must self-perform a certain portion of the construction service. In Japan, there is a company performing the entire works for a construction project without hiring subcontractors. Improvements should focus on advancing the production system within the construction industry. Regulations should consider different areas of specialization within the construction field and should mandate better field monitoring. To that end, there should be active discussion of possible amendments to the existing regulations. I Could offer an alternative proposal. I will make a comparison between ordinance and the law of contract, an established rule of Ministry of the Interior and Safety, if it is legal or not. and I suggest new alternatives in construction.
