국문 초록

어떠한 결합형태가 종전의 법률혼과 다르거나 사회적으로 익숙하지 않은 새로운 것이라 하더라도 그것이 혼인의 실질을 갖고 있고, 종래의 이성간 법률혼과 비교해 보았을 때, 내용 및 기능상 동등한 것이라면, 배제의 명시적 법적 근거가 없는 한 헌법 제36조 제1항의 혼인의 헌법적 보호범위에 포함되는 것으로 볼 수 있다. 그리고 헌법 제36조 제1항은 이러한 헌법적 혼인에 대하여 구성원 상호간 존엄과 평등에 기초하여 혼인이 성립, 유지될 수 있도록 특별히 보장하는 근거가 된다. 새로운 결합의 형태라 하더라도 이들이 스스로 혼인관계를 형성하려는 의사를 갖고 혼인의 현대적 기능을 수행하는 혼인의 실질을 형성한 것이라면, 이들에 대해 헌법 제36조 제1항에 따라 혼인의 자유를 보장하고, 특히 존엄하고 평등한 혼인관계를 형성할 수 있도록 보장해야 하며 이들 결합에 대하여 혼인으로서 평등하게 대우하고 혼인의 형성 및 유지를 위한 기본적 여건과 제도적 여건을 마련하여야 한다.

영문 초록

Any form of union which has the substance of marriage and which can be comparable to legal marriage between a man and a woman in their content and function should be protected by marriage under the Constitution. If there is no stated legal ground to exclude the same sex union from the scope of marriage, same sex marriage should also be guaranteed under the Constitution, although it is new, socially unfamiliar or different from the previous legal marriage. Article 36 section 1 of the Korean Constitution provides the basis for ensuring that marriage can be established and maintained on the basis of individual dignity and mutual equality of the members of marriage. The most important thing in determining whether a union is a marriage is whether they have the free will to form a marriage on their own, and whether they have formed the substance of marriage. If these conditions are met, the state should not reduce the scope of protection by separating marriages in a formal manner, but ensure that these unions form a dignified and equal marriage relationship. The state should not infringe upon the freedom of various marriages, treat them equally as traditional legal marriages, and prepare basic conditions and systems for the them.
