영문 초록

The newly revised Industrial Relations Laws were promulgated and put into effect March 13, 1997, which culminated in the so-called intrinsic reform policy heralded by President Kim Young-Sam, and his administration. The passing of the laws itself set a new precedent in Korean legislative history in the sense that no governmental drive in the past went through such a rigorous litmus test to win nation-wide consensus. A special committee, consisting of representatives of management, labor, government as well as various wise men, was formed by a special request of President Kim to oversee necessary concerns and the impact of the proposed reform laws. Despite the fact that the laws were passed unanimously by National Assembly under the recommendation of the special committee, it sounds paradoxical that the laws were never fully accepted by both the proponents and opponents of reform. They still do not seem to have reached a common ground in interpreting and enforcing the laws. Rather, the controversy around the laws has been growing so strong as to warrant a major revision of the laws in the foreseeable future. This research aims at elucidating the reasons why the new laws are doomed to fail. In particular, the research will offer new perspectives on the controversial laws by focusing on the root causes of the controversy, and further suggest ways to overcome the mounting conflicts. The new paradigm presented in this paper will serve to help generate momentum for a new system of industrial relations, which will proactively meet the needs of a competitive post-industrial state.
