국문 초록

공익의 대표자이자 국민의 인권보호기관으로서의 준사법기관인 검사는 일체의 정치적 압력이나 어떠한 부당한 압력에도 좌우되지 않고 법과 정의 그리고 원칙에 따라 검찰권을 공정하고 불편부당하게 행사하여야 하므로 이를 위한 전제로서 검찰의 정치적 중립성과 독립성을 보장하고 검사가 공정하게 검찰권을 행사할 수 있도록 하는 검사 인사시스템을 마련하는 것이 필요하다. 최초의 근대적 검찰제도이자 한국 검찰제도의 모태가 된 프랑스에서는 사법관(판사와 검사) 인사의 독립성과 객관성, 투명성을 보장하기 위하여 사법관의 임명과 징계를 독립성이 보장된 헌법기관인 최고사법관회의(Conseil supérieur de la magistrature)가 담당하고, 사법관의 승진도 독립된 기구인 승진심사위원회(Commission d’avancement)가 담당하고 있으며, 그 밖에도 객관적이고 공정한 직위공모와 근무평정 제도, 사법관들의 인사 절차에 대한 직접 참여 등을 보장하고 있고, 인사와 관련된 모든 절차에서 투명성의 원칙이 적용되고 있다. 이러한 제도들은 모두 사법관의 인사에 있어서 정치권력의 부당한 영향력 행사를 방지하여 사법관의 독립성을 보장함으로써 사법관이 제 역할을 다할 수 있도록 하기 위함이다. 본 논문에서는 이러한 프랑스 사법관의 인사시스템 중 승진심사위원회에 대한 구체적인 연구를 통해 한국 검찰의 정치적 중립성과 독립성을 보장하고 검사가 공정하게 검찰권을 행사할 수 있도록 하는 ‘독립성ㆍ객관성ㆍ투명성이 보장되는 검사 인사시스템’에 대한 시사점을 검토하였다. 구체적인 내용은 검사의 승진이나 전보 등을 담당하는 독립적인 인사기구 도입, 잦은 인사이동 개선, 직급별 대표의 인사 절차에의 참여 보장, 근무평정결과 공개 및 의견 진술 기회 보장 등이다.

영문 초록

Prosecutors hold the status of a quasi-judicial body to protect human rights of people and keep justice as the representative of public good and protector of people’s human rights. This prosecution power is entrusted in them by the people, which means that they should be independent from political power, not being influenced by any political pressure and unjust internal and external pressure, and exercise their power in a fair and impartial way according to law, justice, and principle, following only the will of the people who have given them the power. It is thus needed to introduce a personnel system for prosecutors to guarantee independence, objectivity, and transparency to guarantee the political neutrality and independence of the prosecution and allow the prosecutors to exercise their power fairly. In France, which introduced the first modern prosecution system and offered the matrix for South Korea’s prosecution system, the Supreme Council of Judges and Prosecutors(Conseil supérieur de la magistrature), a constitutional agency whose independence is guaranteed, is responsible for the appointment and disciplinary action of judges and prosecutors(les magistrats) to ensure the independence, objectivity, and transparency of their personnel. Another independent agency called Committee of Promotion(Commission d’avancement) is responsible for their promotion. In addition, there are objective and fair job posting and efficiency rating systems with the direct participation of judges and prosecutors in the personnel procedure guaranteed. The principle of transparency is applied to all the procedures related to personnel. All of these systems are to prevent political power from exercising its unjust influence on the personnel of judges and prosecutors and guarantee their independence so that they will be able to perform their roles right. This study set out to conduct specific research on the French personnel system of judges and prosecutors and review its implications for the South Korean prosecution’s “personnel system whose independence, objectivity, and transparency would be guaranteed” to ensure that they would have political neutrality and independence and exercise their power fairly. The study made a bunch of specific proposals including installing an independent personnel body in charge of the appointment, transference, and promotion of prosecutors, ensuring their participation in prosecutors’ meetings by the rank and personnel procedures by the rank head, opening their efficiency ratings to the public, guaranteeing them an opportunity to speak their opinions.
