공공후견인관청의 운영에 대한 소고

국문 초록

2013년에 성년후견제도가 도입된 이후에 임의후견제도의 이용비율은 매우 저조한 편이다. 임의후견제도를 이용하지 않는 이유로 다양한 것이 있을 수 있겠지만, 2017년 11월에 법무부에서 실시했던 성년후견제도에 대한 대국민 인식조사에 따르면, 후견계약의 체결절차와 방법 등에 장애요소가 있기 때문일 수 있음을 예측할 수 있다. 따라서 유엔장애인권리협약상 본인의 의사결정능력을 최대한 존중할 수 있는 제도라고 평가되는 임의후견으로서의 후견계약에 대한 접근성을 강화할 수 있는 방안을 모색할 필요가 있다. 이를 위하여 우리나라의 후견계약보다 간이한 방식으로 본인이 의사결정능력에 장애가 생길 수 있는 상황에 대비하여 자신의 사무를 처리할 수 있는 지속적 대리권 제도를 운영하고 있는 영국의 공공후견인관청을 중심으로 검토하기로 한다. 영국은 우리나라의 후견제도가 법원을 중심으로 운영되는 것과 달리 행정기관인 공공후견인관청과 함께 운영되고 있기 때문에 일반국민의 임의후견에 관한 제도의 접근성을 높일 수 있는 모델이 될 수 있다. 특히 본인이 장래를 위하여 자신의 사무를 담당할 대리인을 지정하면, 공공후견인관청이 이를 등록하고 관리함으로써 원활하게 임의후견제도를 운영하고 있다. 또한 법정후견인과 지속적 대리인이 자신의 권한을 남용하여 본인의 이익을 해치지 않도록 감시하는 역할을 함으로써 제도상의 문제점을 보완하고 있다. 이러한 기관은 우리나라의 성년후견제도가 임의후견보다는 법정후견에 치우쳐서 운영되고 있는 현실 속에서 후견인이 본인의 의사를 지원하는 방향으로 나아가야 한다는 유엔장애인권리위원회의 권고사항을 이행하는 데에 중요한 모델이 될 것이다.

영문 초록

The percentage of use of the Guardianship Contract System has been significantly underused since the Adult Guardianship System was introduced to Korea in 2013. The reason that many people don’t use this system could be various. We would predict that the Guardianship Contract System has many problems, such as procedure and method of making the Guardianship Contract according to the public opinion poll about the Adult Guardianship System by the ministry of justice. So we should try to find ways to improve accessibility of the Guardianship Contract System, which is considered as the best system for respecting individuals’ mental capacity to make decisions under the UN Convention on the Rights of Persons with Disabilities. In order to find those ways, I will examine the Office of Public Guardian in the UK that has implemented the Lasting Power of Attorney, which is a simpler system than the Guardianship Contract System of Korea to prepare for the future when individuals don’t have the mental capacity to make decisions. The UK would be a model for improving accessibility of the Guardianship Contract System as it is operated by the Court and the Office of Public Guardian unlike Korea. Especially, if donors appoint any persons as attorneys, the Office of Public Guardian registers and manages attorneys well. And the Office of Public Guardian supervises deputies and attorneys that abuse their authority to protect donors’ interests. In Korea, many people don’t use the Guardianship Contract System as they feel more difficult to use this system than the Legal Guardianship System. So it is important for Korea to examine the operation of the Office of Public Guardian when it comes to complying with the recommendations of the Committee on the Rights of Persons with Disabilities.
