클라우드 컴퓨팅 환경에서 전자정보 압수수색에 관한 입법적 개선방안

국문 초록

최근 전 세계적으로 정보자원 활용방식이 클라우드 컴퓨팅 방식으로 빠르게 전환되면서 클라우드 컴퓨팅은 이른바 ‘4차 산업혁명’의 핵심 전산 인프라로 전 산업분야의 혁신을 견인할 것으로 기대되고 있다. 하지만 ‘분산처리기술’ 및 ‘가상화기술’을 핵심요소로 하는 클라우드 컴퓨팅의 이용확산은 범죄수사를 위한 압수수색에 있어 다양한 법적 문제를 발생시킬 가능성이 있기 때문에 ‘클라우드 컴퓨팅 환경에서의 전자정보 압수수색’에 관한 현행 법체계상의 문제점을 규명하여 개선방안을 시급히 마련할 필요가 있다. 이런 이유로 필자는 지난 2017년 3월 “클라우드 컴퓨팅 환경에서 전자정보 압수수색의 문제점과 개선방향”을 주제로 클라우드 컴퓨팅에서 유통되는 전자정보의 압수수색 시 법적 문제점을 도출하고 그 개선방향을 제시하는 선행연구를 수행한 바 있다. 동 선행연구에서는 전자정보 압수수색과 관련된 ‘법률의 개선방향’으로 ① 압수수색 대상인 ‘전자정보’의 명시, ② 원격 수색제도의 도입, ③ 기록명령부 압수제도의 도입, ④ 영장집행 방법의 개선, ⑤ ｢클라우드 컴퓨팅법｣상 ‘이용자 정보’의 적법한 수집을 제시하였고, ‘정책적 개선방향’으로 ⑥ 영장의 특정성 완화, ⑦ 국제적 협력체계 구축 등을 제시한 바 있다. 하지만, 위 선행연구에서는 상기와 같은 법적 문제점을 도출하고 그 개선방향을 제시하였으나, 구체적인 입법방안은 향후 연구과제로 남겨두는 한계도 있었다. 따라서 본 논문에서는 위 선행연구 결과를 토대로 입법방안을 연구(후속연구)하여 “클라우드 컴퓨팅 환경에서 전자정보 압수수색”에 관한 현행법의 제․개정방안을 제시해 보고자 한다.

영문 초록

In recent years, the use of information resources has been rapidly shifting to cloud computing, and cloud computing is expected to drive innovation in all industries as the core of the so-called “4th Industry Revolution”. However, the spread of cloud computing using ‘distributed processing technology’ and ‘virtualization technology’ can cause various legal problems in the electronic search and seizure for criminal investigation in the cloud computing environment. For this reason, I presented the legal problems and improvement directions of the electronic search and seizure in the cloud computing environment with the theme of “The problems and improvements of Searching and Seizing Electronic Information from Cloud Computing Environments” in March, 2017. For example, in the previous study, I suggested the direction of the legislative improvement(① legislation of ‘electronic information’, ② legislation of remote search system and ③ record order seizure, ④ improvement of warrant execution method, ⑤ legitimate collection of ‘user information’ in cloud computing)” and “the direction of the policy improvement(⑥ mitigation of specifics of warrants, ⑦ establishment of an international cooperation system etc)”. However, in the previous study, I suggested only the legal problems and the direction of improvement, but there was a limit to leave specific legislation as the following study subjects. Therefore, in this paper, based on the results of the previous study, I propose legislative improvements of current law on electronic search and seizure in cloud computing environment.
