국문 초록

개혁개방정책 이후 농민공의 도시 유입은 해마다 증가하고 있다. 최근 중국 경제발전에 대한 농민공의 기여도가 점차 인정되면서, 중국 정부는 농민공을 위한 일련의 조치를 단행하였다. 중국 정부는 기존의 도시와 농촌으로 이원화된 호구제도를 점차 완화하는 동시에, 농민공의 근무환경을 개선하고 급여를 올리며 정치 참여의 길을 여는 등 농민공의 삶을 꾸준히 향상시켰다. 이렇게 그들이 도시에서 점차 시민으로서의 권리를 획득해가는 반면, 농민공의 복지권은 아직 보호받지 못하고 있다. 유동이 빈번한 농민공일수록 특정한 직장이나 거주지를 정하지 못해 사회보험, 공공부조와 복지서비스 등 사회보장의 사각지대에 남겨져있다. 특히 2016년말 현재 2억 8천 171만여명으로 추산되는 농민공들 중 70% 이상은 노동계약 미체결로 사회보험의 사각지대에 놓여 있다. 2011년 7월 사회보험법 시행으로 인해 농민공이 법제도적 대상자임에도 불구하고, 대다수 농민공들이 사회보험체계에서 배제되어 있다. 그러므로 이 글은 사회보험 사각지대에 초점을 두고 농민공의 사회보험 적용범위를 살펴보고, 농민공이 사회보험제도에서 배제된 주요 원인을 분석한다.

영문 초록

Since the opening of the reform and opening, rural-to-urban migrant workers have made great contribution to the economic development in urban China. The influx of China’s migrant workers into the city has increased every year. In 2016 a total of 281.71 million migrant workers (36% of the total workforce of 776 million) existed in China. Out of these, migrant workers who left their hometown and worked in other provinces accounted for 169.34 million (an increase of 0.3% compared to 2015) and migrant workers who worked within their home provinces reached 112.37 million (an increase of 3.4% compared to 2015). China’s migrant workers are commonly members of a floating population, which refers primarily to migrants in China without local household registration status through the Chinese Hukou system. China’s migrant workers are merely socially disadvantaged in the city. Generally, China’s migrant workers are most excluded from education, housing, social welfare programs and many jobs because of their lack of hukou status. Although situatin is much better than the past, China’s migrant workers still face difficulties such as low wages, delayed wages, extension of working hours, working without a labor contract, and nonpayment of social insurance. The enactment of Social Insurance Act in 2011 made it possible to be applied to all migrant workers legally and sytstematically. But the majority of China’s migrant workers are in the blind spot, because they are not coverd by social insurance. Therefore, this article with its focus on the blind spot of social insurance examines the coverage of social insurance for China’s migrant workers and then analyzes the major causes of the exclusion of China’s migrant workers from social insurance system in China.
