여성의 정치적 대표성 확보를 위한 헌법규정 신설에 대한 고찰

국문 초록

1987년 이후 30년 만에 제10차 헌법 개정 논의가 활발하다. 현행헌법은 여성의 차별 금지 및 노동과 모성의 측면에서의 보호를 여러 곳에서 규정하고 있다. 그러나 이러한 다양한 영역에서의 양성평등 규정에도 불구하고 여전히 우리 사회는 사실상 양성 간의 불평등이 존재한다. 성별격차지수와 성불평등지수가 보여주듯이 한국사회는 국가경제수준이나 교육수준에 비해 특히 여성 정치인 비율과 여성 관리직 비율에 현저한 차이를 보인다. 남성과 동등하게 여성도 정치적·경제적 의사결정과정에 참여할 수 있고, 참여할 권리가 있음에 이견은 없다. 다만 남녀의 동등한 정치참여를 위하여 적극적 조치와 특별한 방법을 마련함에 있어 능력주의 또는 역차별 논란이 존재한다. 그러나 역사상 남성과 여성이 동등한 권리를 향유하지 못하였던 사실과 이로 인해 고착된 불평등한 상황은 단순한 차별금지를 명함으로써 해결될 수 없다. 현행헌법상 평등권 규정을 차별금지명령 또는 원칙적. 절대적 차별금지명령으로 이해하는 경우 이를 근거로 국가의 실질적 평등실현을 위한 의무를 도출해내기 어렵다. 헌법상 양성평등에 관한 규정을 어떠한 내용으로 이해하느냐에 따라 우리 공동체의 양성평등에 관한 입법정책에 결정적인 영향을 미친다. 대의민주주의의 핵심인 대표성은 인류의 절반이자, 국민의 절반인 여성이 남성과 동등하게 정치적 대표로서 주요한 의사정책결정에 관여하여 실현될 수 있다. 현존하는 불평등을 제거하고 실질적 평등의 실현을 위해서는 현행 헌법상 평등권 해석의 한계를 인정하고 차별금지명령을 넘어서서, 헌법에 적극적 평등실현조치의 근거 마련과 남녀동권 규정의 명문화가 필요하다. 세계의 다수 국가들 역시 정치적 영역에서 남성과 여성이 동등한 권리를 누리지 못하였던 역사적 배경이 고착화되어 여성의원의 비율이 낮은 것이 현실이다. 정치가 남성의 전유물인 문화는 외국도 우리와 크게 다르지 않아 유럽국가를 중심으로 외국의 입법례를 검토하며 현재 논의 중인 개헌안을 중심으로 실질적 평등의 실현을 위한 조치의 필요성 및 헌법적 정당성을 고찰하였다. 적극적 조치의 헌법적 근거마련 및 공직진출에 있어 남녀의 동등한 접근을 촉진하는 헌법규정은 법과 제도의 개선과 사회의 인식변화를 이끌고 정당의 자발적 참여와 함께 여성 정치참여의 길을 열어주는 시발점이 되리라 기대한다. 여성의 정치적 대표성 확대는 현존하는 차별을 철폐하고 성평등 사회로 이끄는 동력이 될 것이다.

영문 초록

10th constitutional revision is currently being a great debate in Korea. In the 10th constitutional reform, which is occurring after 30 years from the last reforms, focus shall be on the expansion of the fundamental rights of th people. Current constitution contains various standards of special protection of female labor, maternity and equality. Nevertheless, it has to be admitted that the female discrimination is still existing in Korean society. Gender gap index indicates that the proportion of the female representatives are deficient, considering the economical achievement in Korea and the educational level of the female workers. There is no doubt that the women have the same right as men to participate when the political and economical decisions are made. Representation is the core concept of the democracy and therefore the women, half of people, should be able to represent for the people. The law promotes equal access for women and men to electoral mandates and offices as well as to political leadership positions. There are still some discussions how the gender equality can be realized. Constitution as the core of that function comes to be the base for changing democratically social structure including the relationship of both sexes. The culture in which politics is the exclusive property of men is not so different from that of other countries. Foreign constitutional cases mainly in European countries has been examined. In order to eliminate the existing inequalities and realize real equality, it is necessary to recognize the limits of the interpretation of equality rights in the current Constitution, The basis for the realization of affirmative action and the regulations for the equal access of men and women to political domain in the Constitution must be established. Constitutional regulations lead to improvement of laws and institutions and changes in society s perception. Increasing the political representation of women will become a driving force for eliminating existing discrimination and leading to a gender equality society.
