유럽의 변리사중심의 법조전문자격사 동업과 시사점

국문 초록

법률시장의 개방에 즈음하여 변리사업계와 변호사업계 등 법조전문자격사들은 직역수호를 위한 각자도생으로 대응하고 있으며, 중앙부처도 경제파트와 법무파트간의 대립된 주장을 하고 있으나, 법률소비자의 권익보호, 지적재산권 보호 및 국가경쟁력의 확보를 위하여 법조전문자격사간의 동업은 필수적이므로, 향후 입법개선을 위하여 심도있는 연구가 필요하다. 2017년 3단계 법률시장의 개방으로 지재권보호의 필요성이 대두되고 있음에도 국내법제에서는 법조전문자격사간의 동업이 금지되어 있어 국내 지재권시장이 위험에 노출되어 있다. 이에 대한 정책연구의 자료를 제공하고자 유럽(영, 프, 독)의 법조전문자격사 동업법제와 국내법제를 비교분석하여 시사점을 얻고자 한다. 법조전문자격사간의 동업을 허용하는 독일과 프랑스의 동업제도도 법률관련 서비스의 일괄제공에 긍정적 효과가 있지만, 영국의 ABS는 법조전문자격사 뿐 아니라 기타 전문자격사들의 동업참여를 허용하는 것으로서 향후 글로벌 법률서비스시장에서 커다란 영향을 미칠 것으로 보인다. 우리나라도 글로벌화하는 법률서비스시장과, 복잡다양해지고 있는 과학기술분야의 특징을 고려하여, 변리사 중심의 동업을 허용함으로써, 지재권분야의 시장개방에 대응하고, 나아가 국내 재재권의 해외진출에도 긍정적 효과가 나타나도록 제도개선을 하여야 할 것이다. 그러므로 본 논문은 영국을 중심으로 유럽의 법률서비스 동업허용 법제현황을 살펴보고, 우리나라 동업금지규정과 비교분석하여, 우리나라 법제에 시사하는 바를 검토해보고자 한다.

영문 초록

In the opening of the legal market, legal professionals such as patent attorneys and professional lawyers are responding to each other for the protection of the legal status. The central ministries also make contradictory claims between the economic part and the legal department. In order to protect intellectual property rights and secure national competitiveness, partnership between patent attorneys and professional lawyers is essential, and further research is needed to improve legislation. Although the need to protect IPRs is emerging due to the opening of the third-stage legal market in 2017, the domestic IPR market is at risk due to the prohibition of partnership among legal professional entities. In order to provide policy research data, I would like to obtain some implications by comparing and analyzing the partnership legislation of European legal experts (UK, German and French). The German and French partnership system, which allows partnerships between patent attorneys and professional lawyers, has a positive impact on the provision of law-related one-stop services, but ABS in the UK allows partnership between not only lawyer but non-legal professionals, It will have a big impact on the market. Considering the characteristics of the global legal service market and the increasingly complicated science and technology field, Korea should also respond to the positive effects with market opening in the IPR field by allowing patent attorneys-entered partnership. Therefore, this paper examines the current status of the legal system for legal services partnership in Europe, focusing on the UK, and make a comparative analysis with the provisions banning partnership in Korea, and review what is implied in Korean legislation.
