국문 초록

오늘날 초국가적 안보위협에 대해 선제적 국가안보 수호를 위한 정보기관의 역할은 강화되는 추세에 있으며, 정보기관과 법집행기관의 조직적 통합과 정보ㆍ수사의 기능적 교류 강화라는 연계 과제가 요구되고 있는 실정이다. 아울러 세계 주요 국가들은 국가안보범죄에 대해 정보ㆍ수사기관에 충분한 권한을 부여함과 동시에 그에 대한 책임을 분명히 하고 있다. 이에 정보기관의 활동에 필요한 범위 내에서 충분한 권한을 부여하고, 그에 상응하는 책임을 명확히 하여 국민들에 의한 민주적 통제가 이루어지는 정보기관으로 발전되어야 한다. 특히 국가정보환경의 변화에 따라 정보활동과 안보수사기능 역할의 재정립에 대한 국민들의 신뢰 형성과 공감대를 형성하고, 이에 상응하는 정보활동과 안보수사 기능의 그 존립체계에 대한 신중한 논의가 필요하다. 마지막으로 국민의 생명과 신체 및 재산이라는 근본적인 법익 보호를 위해 이루어지는 정보ㆍ수사활동이 국가존립의 근본 목적을 달성하는데 중요한 일익을 담당하고 있다는 인식을 공유하고 이해해야만 한다.

영문 초록

Today, the role of intelligence agencies for the protection of preemptive national security against transnational security threats is on the rise, and there is a demand for a linkage between organizational integration of intelligence agencies and law enforcement agencies in strengthening function. In addition, major countries in the world have given sufficient authority to intelligence and investigation agencies on national security crimes and clarify their responsibilities. Therefore, it should be developed as an intelligence agency where democratic control by the people is made by granting sufficient authority within the scope necessary for the activities of the intelligence agency. Especially, it is necessary to form public consensus on the reestablishment of intelligence activities and security investigation functions in accordance with changes in the national intelligence environment. And intelligence activities and security investigation functions system is needed careful discussion . Finally, intelligence and investigation activities are carried out in order to protect fundamental interests of people s life, body and property. It is important to share and understand the perception that it is important for achieving the fundamental purpose of national existence.
