자치경찰제도 도입 정부(안)에 관한 지방자치 부합성 검토

국문 초록

문재인 정부는 최근 자치경찰제도를 도입하겠다는 강한 의욕을 가지고 그 제도에 관한 내용을 발표하였다. 자치경찰제도는 지방자치라는 범위 내에서 이루어지는 것으로 지방자치와 별개로 논해 질 수 없다. 즉 지방자치를 완성하고 지방자치 라는 자치제도를 추진하기 위해 자치경찰제도 도입은 필요하게 된다. 자치경찰제도는 현행 지방자치에 부합하도록 제도가 도입되어야 하는 것이며,정부와 지방자치단체의 필요에 의해 실시되어서는 아니 된다. 자치경찰제도는 지방자치라는 범위에서 지방자치를 구성하는 한 요소인 것이지 자치경찰제도가 목 적이 될 수 없다. 자치경찰제도는 헌법의 지방자치의 기본적 이념과 풀뿌리 민주주의를 실현할수 있어야 한다. 그러기 위해서는 자치경찰제도는 가장 저변인 기초지방자치단체에서 이를 실시하는 것이 필요하다. 또한 자치경찰사무 또한 지역의 치안확보를 위해 요구되는 사무를 수행할 수 있어야 한다. 그러나 현행 정부(안)은 이러한 지방자치의 본연의 취지에 부합하지 않는 한계를 가지고 있다. 즉 자치경찰제도 설치 단위를 광역지방자치단체로 하고 있어, 기초지방자치단체의 자치권을 침해하는 한계를 가지고 있다. 또한 자치경찰사무에 있어 협의적 의미의 행정경찰사무와 단순한 성폭력과 가정폭력에 한정하고 있어,경찰사무를 제대로 수행하지 못하는 한계를 가지고 있다. 따라서 본 연구는 현 정부가 발표한 자치경찰제도가 지방자치에 부합하는 가에 대하여 검토하였다.

영문 초록

Moon, Jae-in government recently announced that it will introduce local self-governing police system by showing strong willingness. However, the local self-governing police system cannot be discussed by separating from local autonomy because it should be operated within its local autonomy. For this reason, introducing the local self-governing police system should be accorded to local autonomy. Thus, the system should not be carried out by the need of the government and local autonomy. Furthermore, the system should not be a purpose for local autonomy because it is just a component consisting of local autonomy. Also, the local self-governing police system should make sure its local security that is one of its duties. However, the system has some limitations so it does not go well with the original purpose of local autonomy. As a first limit, the government allows the local self-governing police system to be settled only in large-size cities, such as Incheon, Daejeon, and Gwangju, so forth. Thus, this limit could damage the self-governing right of basic local autonomy. Next, the system also puts a limit on the duties of the self-governing police so its duties are restricted only in administrative works of a narrow-meaning and simple sexual and family violences. As a result, these limits keep the local self-governing police from doing their duties well. Therefore, this study reviewed if the local self-governing police system, which is recently issued by Moon jae-in government, is correspondent to local autonomy. In addition, the local self-governing police system should achieve grass-rooted democracy as well as the original idea of local autonomy stated in the Constitution. To do this, the local self-governing police system should be operated within basic local autonomy.
