우리나라에서의 협치(協治)를 위한 공동정부의 가능성과 그 규범적 조건

국문 초록

국가기관 상호간에 협력적 의사결정을 위하여 정당간에 정책연합을 만들거나 좀 더 강한 형태로 공동정부를 구성하는 경우를 볼 수 있다. 국회의 의사결정 또는 정부까지를 포함한 국가의사결정과 집행을 위하여 둘 이상의 정당이 협약을 체결하고 이에 따라 국회에서의 다수를 형성하고 행정 각부의 장 등으로 국정운영에도 참여하는 것이다. 이는 흔히 공동정부 협약이라 할 수 있다. 공동정부 협약은 대통령선거를 앞두고 또는 원활한 국정운영을 위한 경우처럼 다양한 이유에 의하여 등장할 수 있다. 공동정부의 구성은 현실적으로 대통령이 실질적 권한 행사가 보장된 국무총리를 임명하여 정부를 운영하는 방식도 가능하며 아예 당의 대표가 참여하는 공동정부운영기구의 의사결정을 통하여 대통령이 권한 행 사를 결정하거나 제한하는 방식도 등장할 수 있다. 그러나 공동정부협약은 대통령선거나 국회의원선거에서 나타난 국민의 정치적의사를 왜곡하여 대표관계를 왜곡할 수 있으며, 인위적인 국회 내 다수의 형성에 따라 권력분립원리가 작동되지 않게 될 가능성도 있다. 또한 권한의 분산이나 공 유와 함께 책임의 분산도 수반되어 대표관계의 핵심적 요소인 책임이 실종되는경우도 예상할 수 있다. 공동정부협약의 이행과 관련하여 그것이 지속적으로 국민의 신임에 기초하여 통제될 수 있기 위해서는 밀실에서의 담합이 아니라 국민의 통제를 받아야 할 것이므로 합의의 내용이 공개되어야 한다. 또한 정당에서의 공동정부구성에 참여하는 의사결정의 과정이 민주적이어야 하며, 국회 안에서의 의사결정도 합리성에 기초한 논의와 의사결정이 전제되어야 한다.

영문 초록

It can be seen that there is an agreement to form a policy coalition or joint government between political parties for cooperative decision-making or governance. In 1997, president candidate Kim Dae Jung made a coalition covenant with another president candidate Kim Jong Pil. In order for national decision-making and execution, including the decision of the National Assembly or the government, two or more political parties conclude an agreement, thereby forming a majority in the National Assembly and participating in the administration of the state by the heads of administrative departments. A policy coalition or joint government agreement may appear for a variety of reasons, such as before the presidential election or for rational state administration. However, the policy coalition or joint government agreement may distort the representative relationship by distorting the political will of the people in the presidential election or the parliamentary election, and it is also possible that the formation of the majority in a parliament artificially may hinder the power separation principle from working. It can also be expected that responsibility, which is a core element of the representative relationship, is lost due to the distribution of responsibility as well as authority. In the context of the implementation of the policy coalition or joint government agreement, the content of the agreement must be disclosed, since it will need to be under the control of the people. In addition, the decision-making process in a party to participate in the policy coalition or joint government should be democratic.
