창의노동 관점에서 바라본 ‘예술인 복지법’에 대한 비판적 고찰

국문 초록

2011년에 제정된「예술인 복지법」은 문화예술분야에 종사하는 예술인들이 노동 현장에서 겪게 되는 구조적 문제를 보완하고 이들이 수행하는 예술활동의 사회적 가치에 대한 인식을 제고할 필요가 있다는 문제의식에서 출발하였다. 그러나 「예술인 복지법」제정 이후 현재까지 진행된 예술인복지를 위한 정책내용을 들여다보면 여전히 문화예술분야의 노동과정이 갖고 있는 특수성에 대한 고려가 매우 미흡한 것이 사실이다. 다른 직업과 비교했을 때 특별히 예술인들을 사회적으로 지원해야 하는 이유에 대해 충분한 사회적 공감과 동의가 전제되지 못한다면, 문화예술분야의 노동에 대한 사회적 지원은 오래 지속되기 어려울 수밖에 없다. 이런 배경에서 본 연구는 󰡔예술인 복지법󰡕에 반영된 예술인 노동에 대한 인식과 주요 쟁점들을 비판적으로 고찰하는 것을 목적으로 한다. 이를 위해 먼저 창의노동 관련 연구들을 통해 예술인을 포함한 창의노동자들의 노동과정 특성이 직업적 불안정성과 경제적 취약성으로 이어질 수밖에 없음을 검토한다. 이어 「예술인 복지법」과 관련 정책들에 대한 사례분석을 통해 예술인복지정책에 투영된 예술인 노동에 관한 정책 인식 및 주요 쟁점들을 가치정향의 문제 및 정책수단적 방법론 차원에서 분석한다. 이를 토대로 결론에서는 예술인들의 창작활동이 본질적으로 경제적 취약성에서 자유로울 수 없는 창의노동 특수성에 대한 고려를 바탕으로, 현재의 예술인 복지정책의 문제점과 개선방향을 새로운 관점에서 탐색, 제시한다.

영문 초록

The artists welfare act, which was enacted in 2011, was designed based on the need to improve the working conditions of artists and to enhance their economic stability. Although the specific welfare act ostensibly recognizes the important social role of artists, it is seemingly that the act does not sufficiently reflect the specificity of artistic/cultural working process, which tends to force artists/cultural laborers become vulnerable in society. It may not be easy to build a sustainable welfare system for a longer term, unless there is solid social consensus on the particular reasons why social supports for artists/cultural labourers are necessary. In this sense, this study aims to critically analyse the current artists’ welfare act in relation to the theories of creative labour process. Firstly, the study examines why and how artists/creative labourers are vulnerable to economic instability from the perspective of the creative labour process, Then it moves on to present a case analysis about the bill texts of Artists’ Welfare Act and the characteristics of the related artist policy initiatives. By doing so it illuminates some critical problems in both the ends and means of the current artists welfare policy initiatives. In conclusion, it presents some possible suggestions that may help the current artists welfare policy initiatives better reflect the specificity of artists’ creative labour process. By articulating the fundamental economic vulnerability of artists’ creative production processes with theories of creative labour, the current research explores several important issues of the current artists’ welfare act, and suggests possible future directions of the amendment of the act.
