국문 초록

최근 초고속통신망과 정보통신기술의 발달로 개인정보보호의 중요성이 매우 커지고 있다. 이와 함께 수사목적 개인정보의 제공과 관련하여 개인정보자기결정권에 대한 인식의 변화를 반영한 판례가 등장하고, 관련 기업의 태도변화가 생겨나고 있으며 기존법제에 대한 개정움직임도 일고 있다. 이런 변화의 핵심내용은 수사기관의 통신자료 요청 시 영장주의를 적용하자는 것이다. 이 연구는 이와 같은 변화상황에서 기본적 개인정보라 할 수 있는 통신자료에까지 영장주의를 적용하는 것이 합당한지에 대한 검토를 시도하였다. 먼저 국내의 법규현황 및 동향을 살펴보고, 외국의 법제를 비교법적 시각에서 고찰하였다. 그리고 영장주의의 본질, 개인정보자기결정권의 제한 및 수사과정에서의 권리침해 가능성 등 관련 논점을 검토해 수사목적 통신자료의 이용에 영장주의를 적용하는 것이 타당한지 여부에 대한 결론을 제시하였다.

영문 초록

Personal information protection is more important than ever in South Korea. The development of high-speed communications networks means that South Koreans live in an increasingly networked world. The reality of personal information protection becoming increasingly more important has given way, among others, to the following set of developments: judicial decisions incorporating the current view regarding individual right to control the circulation of information relating to oneself, relevant business operators experiencing change in policy and practice regarding disclosure of subscribers’ personal information, and existing laws undergoing revisions to better reflect current reality and needs. This study examines whether it is proper and constructive to apply the principle of requiring a warrant to access communications data, considered to be basic personal information, for investigative purposes. In other words, this study focuses on whether relevant South Korean laws should require a warrant to compel disclosure of communications data to be used for investigative purposes. First, the study explores the theoretical discussions. Second, South Korea’s relevant laws and current judicial and legislative stance are looked at. Third, laws and regulations of a select developed countries on the matter are discussed from a comparative perspective. The study then concludes that for investigative purposes, it is inadvisable to require a warrant to access communications data for investigative purposes.
