사회복지서비스전달체계의 변용에 관한 연구

국문 초록

1970년대 초에 외국의 원조가 줄어듬에 따라 우리나라 정부에서 사회복지시설에 대한 보조금을 늘려나갔는데 사회복지시설들을 지원하고 감독하기 위하여 만든 법이 사회복지사업법이다. 이 법을 근거로 하여 사회복지시설은 보건복지부장관의 허가를 받은 사회복지법인에 의해 운영되며, 보건복지부, 시도, 시군구의 지도감독을 받고 일정 비율이상의 사회복지사의 자격을 가진 사람들이 사회복지시설운영에 참여하게 되었다. 사회복지사업법은 사회복지사업의 범위를 정하고 있으며 사회복지사업을 하는 주체들이 지켜야 할 사항들을 정하고 있는데 사회복지분야가 확대됨에 따라 모두 7회의 개정을 하였으며 이중에서 1992년과 1997년의 전면 개정은 중요한 의미를 가진다. 이 연구에서는 제정법, 1992년의 개정법, 1997년의 개정법의 개정과정을 공적 전달체계, 사회복지 인력, 사회복지법인 및 사회복지시설, 사회복지사업의 범위 등의 측면에서 분석하였다. 1987년부터 읍면동에 배치된 사회복지전문요원에 대하여는 1992년의 법 개정시에 그 법적 근거를 확보하였다. 그러나 사회복지사무소는 시군구에 설치하도록 1992년에 법적인 근거를 확보하고 시범사업을 실시했음에도 불구하고 아직도 설치가 되지 못하고 있다. 1997년의 개정법 이후에는 정부 또는 사회복지법인만이 설치 운영할 수 있던 사회복지시설을 개인도 설치 운영할 수 있게 되었다. 1997년 개정법에 따라 사회복지시설의 평가제를 도입하고 시설보호인원의 상한선을 정하는등 시설운영의 투명성과 개방성을 보장하기 위한 방안들을 마련했다. 사회복지분야가 다양해짐에 따라 다양한 형태의 사회복지서비스형태가 나타나고 있는데 우리 사회에서 보호가 가장 필요한 사람들이 살고 있는 사회복지시설이 시민들의 감시에 의해 운영이 더욱 투명하게 될 수 있도록 하기 위해서 앞으로도 지속적인 개선이 필요하다.

영문 초록

After financial support from abroad for the social welfare institutions decreased in the early of 1970s, Korean government increased the subsidy to the social welfare institutions. In 1973, the Social Welfare Service Law was enacted to enforce rules for delivering social welfare services and also for supervising the social welfare institutions. The social welfare institutions ere owned and managed by the social welfare foundations, which was authorized by the Ministry of Health and Social Welfare. By the delegation of the Ministry, provincial governments and local governments also subsidized and supervised the institutions. Some personnel in the institution were required to have ’social worker’s license. The Social Welfare Service Law defines the social welfare services and the rules that should be observed in working for the social welfare services. The diversifying expansion and changes in the social welfare were essentially reflected to the Law and thereafter amendments were made. The Law was amended 7 times and the amendment of 1992 and 1997 included important changes. This study aims at analyzing the law-making process and at comparing the enactment of 1973, the amendment of 1992, and the amendment of 1997 in terms of public administrative systems, license to practice social work, social welfare institution and foundation, and the scope of social welfare services. After the licensed social workers were recruited as local government officers in 1987, the 1992 Amendment gave the officers the core role of the public welfare service delivery systems. But the social welfare office newly put in the 1992 Amendment has not yet been established in the local government because of the opposition of the Ministry of Home Affairs. Before The Amendment of 1997, social welfare institutions was owned only by the governments or social welfare foundations. But by the Amendment of 1997 individuals have been able to own and manage social welfare institutions. Other changes such as the assessment of the institutions and the limitation of the residents’ number were newly invited to make the institutions more open and clear to the citizen. As various forms of social welfare services have come into existence, many kinds of public and private sectors participate in the service delivery. Because most of the service recipients are vulnerable persons who should be protected by the society, more improvement should be made for the delivery system including c\social welfare institutions to open to the citizens’ supervision and to guarantee the recipients’ quality of life.
