자율주행자동차의 도로 관련법상 운전자 개념 수정과 책임에 관한 시론(試論)

국문 초록

최근 전 세계 자동차산업의 화두는 자율주행차의 운행과 그를 둘러싼 주요현안, 특히 기술적ㆍ법적 제도의 개선이라고 할 수 있다. 자율주행차는 자율주행이라는 기술진보적 관점 외에 자율주행차를 둘러싼 산업경제적 효과도 매우 클 것으로 예측된다. 그런데 자율주행기술의 등장은 많은 법적 과제를 새로이 던져 주고 있다. 형사법 분야도 예외는 아니어서 형사책임의 귀속에 있어 전통적 형법이론의 적용이 위협받고 있으며 패러다임의 전환이 요구되는 상황이다. 자율주행차가 상용화되어 실제 도로를 주행할 경우 사회 전반의 혁신을 가져올 것이다. 그러나 이러한 사회변화는 자율주행차량을 둘러싼 법적 과제, 주의의무위반과 객관적 귀속, 사고 회피과정에서의 긴급피난, 제조물의 결함으로 인한 제조업자의 형사책임 등이 충분히 해결된 바탕 위에서 가능하며, 그 첫 단계는 현행 도로 관련법상의 차량 운전자가 누구인지를 확정하는 문제에서부터 시작된다. 자율주행 자동차의 시험 주행과정에서의 사고는 사실적 측면에서, 자동차관리법의 자동차 개념과 도로교통법상 운전자와 그를 전제로 한 형법상 업무상과실치사상죄, 교특법 위반죄 등의 관계에 있어 규제의 부재와 규범적 부정합성은 규범적 측면에서 운전자의 확정과 그에 따른 책임의 귀속을 더 이상 늦출수 없게 만들고 있다. 음주 후 자율주행자동차에 탑승하여 자율주행모드로 목적지에 도착한 경우 음주운전인가? 이런 질문에 대한 답을 낼 수 있어야 한다. 최근 독일과 미국은 자율주행자동차의 주행 등에 대해 새로운 입법안을 마련하고 있다. 그런데 2017년 통과된 독일의 도로교통법은 책임소재가 지나치게 모호하며 제조업자의 직접적인 책임을 부정하였다는 점에서 타당하다고 할 수 없으며, 이 점에서 현재 논의가 진행 중인 미국 캘리포니아주의 입법방향이 바람직하다고 할 수 있겠다. 이러한 관점에서 살펴보면, 자율주행자동차에서의 운전자 개념의 핵심은 주도적ㆍ물리적 개입을 통한 차량의 지배와 주행상황의 장악이다. 자율주행기술의 분류체계와 형사책임의 귀속가능성을 기준으로 자율주행 Level, 운전자의 상시감시와 비상상황 개입 필요에 따라 판단함이 타당하다. 그 결과 이원적 접근으로 Level 3와 운전자주행모드상태의 Level 4까지는 도로교통법의 개정으로 형사책임의 주체로서 제어책임을 지는 자연인인 운전자를 명시하고, 동시에 자율주행모드상태의 Level 4와 Level 5 단계에서는 도로교통법의 개정 내지 자율주행자동차 (제조물)책임법 제정을 통해 제조업자의 안전운행 책임을 명시함이 타당하다고 생각된다. 독일에서 제조업자에게 책임을 묻지 않는 것은 독일 자동차업계가 후발주자로서 자율주행자동차 시장의 선점을 빼앗길 수 있다는 우려도 반영된 것이라고 볼 수 있다. 그러나 이러한 정치ㆍ산업적 고려는 법적 고려에 우선할 수 없다.

영문 초록

Recently, the topic of automobile industry in the world is in particular the improvement of technical and legal systems about the operation of autonomous vehicle(AV) and the major issues surrounding it. The AV is expected to make considerable effects. However the emergence of AV technology has given rise to many new legal challenges. The field of criminal law is no exception. If AV is commercialized, they will bring innovation to society as a whole. However, this social change is possible only on the solution of the legal issues surrounding AV, duty of care, necessity and the liability of the manufacturer. The step begins with determining who is the driver of the vehicle. Determining the driver in AV and his responsibility is no longer can be delayed in the realistic aspect, because of the accident during the test driving and in normal aspect because of the unconformity and the absence of standards between the Traffic Laws and other laws. Recently, Germany and the U.S. are preparing new legislative proposals for AV driving test. However, the German Traffic Laws passed in 2017 is too vague and it is not reasonable to deny the direct responsibility of the manufacturer. In this aspect, the legislative direction of the state of California under discussion is desirable. From this point of view, the driver in AV has to be determined based on the autonomous driving level and the possibility of criminal responsibility, according to the driver’s need for constant monitoring and emergent intervention. As a result, in the level 3 and the level 4 of the driver’s driving mode we can state the human driver who is in charge of control by the revision of the Traffic Laws. And in level 4 of autonomous driving mode and level 5, it is reasonable to state the responsibility of the manufacturer of the vehicle through the amendment of the Product Liability Law or similar new Acts.
