피해자, 그리고 가해자로서의 ‘여성’은 누구인가?

국문 초록

이 글은 여성에 대한 폭력, 즉 젠더에 기반한 폭력이 촉발되는 가장 근본적인 원인과 이 범죄가 위중하게 다뤄지지 않는 바로 그 이유를 여성에 대한 편견, 즉 문화 부정의의 맥락에서 살피는 것을 목적으로 한다. 이를 위해 그간의 법제도화 및 정책개입이 왜 젠더폭력을 근절시키지 못하였는가를 탐구하는 데 있어 젠더전형성에 기인한 차별적 편견이 이 범죄에 대한 정서적이고 감정적인 이해에 영향을 미쳐왔음을 살펴본다. 여성은 공격적이지 않다는 성별화된 신화 내에서 여성의 행위는 사악하거나 비정상적인 것으로 간주되어 여성은 비난 혹은 동정의 대상이 된다. 이는 특정한 맥락과 배경에 위치한 여성의 동기, 감정, 저항, 좌절, 한계, 선택, 그리고 결정의 과정과 그 이유들을 삭제함으로써 여성이 마주한 성차별적 사회구조에 대한 분석을 제거한다. 무엇보다 여성다움을 기준으로 여성을 단선적이고도 이분법적으로 판단하는 것은 남성과 동등한 가치를 지닌 합리적이고 이성적 인간으로서의 여성에 대한 인식을 방해한다는 점에서 문제적이다. 이에 이 글은 여성 그 자체에 대한 편견 없이 여성이 경험하는 사건을 판단할 것, 여성에 집중하려거든 여성의 삶의 맥락과 조건에 초점을 두는 것이 여성에 대한 폭력을 사회정의의 차원에서 접근할 수 있는 유일한 방법임을 제안한다.

영문 초록

This article explores the ways in which the fundamental cause of violence against women is relevant to cultural injustice that persists in a society in the form of an unequal recognition of women’s worth and status. Given the assumption that the criminal justice system and public policy are critical to eradicate gender-based violence, this article raises a question of whether cultural stereotypes about women and gender has impact on the ways in which the matter of violence against women is understood and handled. Based on the theoretical reviews on women and men in family crime, this research sheds lights on how gender stereotypes differently constructs the images of women and men as well as an idea of an incident itself. While women’s aggressive acts are mostly interpreted as biologically deviant or morally bad, men’s violent acts are addressed as reasonable and rational decisions and choices. Under the framework of bad-mad dichotomy of women’s acts, it is difficult to analyze structural injustice that women face and experience in their lives. Most importantly, women are hardly regarded as serious human beings when they are subject to gender norms and roles. In this vein, this articles suggests that it is significant to address the issue of violence against women from the perspectives that reflects women’s socially and culturally situated contexts and conditions rather than who they should be.
