국문 초록

최근 저작자가 권리행사를 원하지 않고 자신의 저작물을 많은 이용자들이 자유롭게 이용하길 희망하는 저작자 및단체(예컨대, 정보공유연대, creative commons )가 등장함에 따라 저작물의 자유로운 이용을 표시하기 위한 수단으로서의 ‘자유이 용 표시 ’ 또는 ‘저작물 이용허락표시 ’ 제도가 주목을 받고 있다. 권리자가 저작권 행 사 를 희망하지 않고 제3자가 자신의 저 작 물을 자유롭게 이용하도록 허락하고자 하는 경우, 저작물 이용조건에 관 한 의사를 저작물에 명확히 표시하여 그 범위 내에서 는 이용자들이 저작물을 자유롭게 이용할 수 있도록 하는 표준인 『의사표시시스템, 즉“자유이용표시 ” 내지 “저작물 이용 허 락표시 ” 시스템을 개발하여 보급 할 필요성이 높다. 본고는 저작권법상 ‘저작물 자유이용표시 ’ 제도의 효과적인 보급 및 정착을 통한 저작권법상 원활한 저작물 유통을위한 저작권표시제도의 운영 가능성을 검토하고자 한다. 특히. 저작물 자유 이용표시제도와 관련된 일 본 문화청의 “자 유 이용마크 ”제도와 “Creative Commons ”의 Creative Commons License 제도를 분석함으로써 , “저작물 자유이용표 시 ”의 내용, 즉 그 법적 지위, 개념, 분류, 이용에 대한 세부적인 사항을 분석하여 저작물 이용허 락표시제도의 운영 방향을 살펴보고자 한다.

영문 초록

What is a “Free Use Mark”? When a copyright holder decides that the work may be freely used by others, he or she displays a “Free Use Mark” on the work to declare that intention. The type of mark displayed signifies the scope of permissible use. For promotion of smooth distribution of digital media contents, in Japan the GOJ will start to support efforts to establish a new distribution system that combines new technology and the copyright contract system and to develop and disseminate various systems such as the contact system for copyright licenses on computer networks and the system for right holders’ declaration of intention concerning the scope of contents to be available. The system of “Free Use Mark” seeks to accomplish many of the same goals as the Creative Commons. ‘Creative Commons Korea’ was recently launched in Korea. It builds a system of permission to copyrighted work on line and benefits both copyright owners and users. ‘Creative Commons License’ promoted by Creative Commons, is a kind of standard agreement to give ‘permission’ under copyright law. Basically, it permits users free use of copyrighted works, but some rights can be reserved based on copyright owners’ intentions. This study aims to offer a better understanding of the legal issues related to the System of “Free Use Mark” on the work.
