건축법상 조경기준과 CPTED 조례의 충돌 - 쓰레기 보관공간의 조경기준을 중심으로 -

국문 초록

본 연구에서는 셉테드 관련 건축 조례와 충돌하는 조경기준을 지적하고 이를 해결하기 위한 내용들을 검토해본다. 셉테드 관련 단일법은 존재하지 않는 다. 하지만 “국토의 계획 및 이용에 관한 법률”, “국토기본법”, “건축법” 에서 안전과 관련한 내용들을 찾아볼 수 있다. 도시계획 수립지침의 경우, “도시⋅군 기본계획 수립지침”, “도시⋅주거환경 정비계획 수립지침”에서 안전 및 셉테드의 내용을 찾을 수 있다. 그 밖에 지방자치단체에서는 조례를 제정하여 셉테드 관련 내용을 규정하고 있다. 그러나 이러한 셉테드 관련법들은 관련 법령이 파편화된 모습으로 다른 법규범과 충돌하는 모습을 띠기도 한다. 건축법상 쓰레기 보관공간의 조경기준이 그 대표적인 예이다. 고시된 조경기준은 차폐 식재를 권장하고 있으나 셉테드 조례는 자연감시가 가능한 개방형 공간을 권고하고 있다. 규범이 충돌하는 경우 두 가지 기준이 보호하는 법익을 비교하여 우월한 법익을 우선시해야할 것이다. 이에 따르면 셉테드 기준이 단순 건축법상 조경기준보다는 우위에 있다고 보인다. 이러한 셉테드와 조경문제 뿐만 아니라 직⋅간접적으로 안전과 연관된 법규범을 재정비하여 규범 충돌의 문제를 해결해야할 것이다.

영문 초록

This study discusses conflicts between landscape standards and building ordinances regarding CPTED and reviews possible solutions. While there is no single act on CPTED, provisions on safety can be found in the Act on the Planning and Utilization of the National Land, the Framework Act on the National Land and the Building Act. As to the guidelines for urban planning, provisions regarding safety and CPTED are stipulated in the Guideline for the General Plan for the City⋅County and the Guideline for the General Plan for Urban⋅Housing Environment. Other local governments enacted ordinances stipulating the CPTEDrelated provisions. However, such CPTED-related laws are in the form of fragmented ordinances, often conflicting with other laws and regulations. A prime example is the landscape standards for garbage storage space under the Building Act. While the notified landscape standards recommend screen planting, the CPTED ordinances recommend an open space that allows natural surveillance. When conflicts among laws, rules, and/or regulations are found, it is necessary to review the values pursued by each law, rule, and/or regulation and determine which value should prevail. In our view, the CPTED standards should prevail over the landscape standards under the Building Act. It is necessary to solve the conflicts of the rules and regulations by realigning those on CPTED and the landscape issues as well as those directly or indirectly linked to safety.
