국문 초록

신분등록제도와 거주등록제도는 사회정치체제에 의해서 강한 영향을 받는다. 이런 이유로 남북한의 신분 및 거주등록제도는 분단 이후 서로 다른 방향으로 발전하여 현재 그 목적이나 성격에서 적지 않은 차이를 보인다. 남한에서는 이원화되어 있는 가족관계등록제도와 주민등록제도가 운용되고 있는 반면 북한에서는 일원화되어 있는 신분등록제도, 공민등록제도와 주민등록제도가 확립되어 있다. 신분 및 거주등록제도가 일상생활과 밀접하게 관련 있음을 고려한다면 이러한 차이는 미래 어느 시점에 있을 통일에 따른 남북한 제도의 통합에 적지 않은 걸림돌이 될 수밖에 없다. 그런 의미에서 지금부터 통일을 전제로 하는 신분 및 거주등록제도의 통합에 대비하는 것이 필요하다. 이 연구보고서는 바로 이런 목적을 위해서 작성된 것으로서, 북한의 신분 및 거주등록제도에 관한 내용을 조사하여 정리하고 이를 토대로 남북한의 제도를 통합하는 데 해결해야 할 여러 과제를 논의한다. 이를 위하여 이 연구보고서는 첫째, 그동안 국내에 소개되었던 북한 제도와 관련된 자료를 재검토하고 이와 더불어 공개가 완전히 되지 않았거나 상대적으로 덜 알려져 있는 자료를 조사하여 소개한다. 특히 북한에서 ‘절대비밀’로 취급되는 ‘주민등록사업참고서’와‘평양 전산 주민등록대장’의 내용을 분석하여 그 핵심 부분을 정리한다. 둘째, 북한이탈주민들과의 인터뷰를 진행하여 북한의 신분 및 거주등록제도가 실제로 어떻게 운용되고 있는지 살펴본다. 북한이탈주민들과 심층면담을 여러 차례 진행하여 기존 자료의 정확성을 확인하고 잘못된 부분을 바로 잡아 북한 제도에 관한 자료를 업데이트한다. 셋째, 북한의 신분등록제도, 공민등록제도와 주민등록제도에 직·간접적으로 영향을 미친 주요 법제인 구(舊) 소비에트연방과 중국의 제도를 개관한다. 두 나라에서 사회주의 체제의 확립 이전과 이후를 비교하여 사회주의제도의 주요 특징을 알아보고, 이를 기초로 하여 북한의 제도가 갖는 특성을 고찰한다. 마지막으로 남북한 제도의 통합에 대한 전망과 이를 위해서 해결해야 하는 과제를 논한다. 독일이 통일과정에서 경험한 제도의 통합을 먼저 검토한 후 통일한국에서 하나의 신분등록제도와 거주등록제도를 구축하기 위해서 제시되고 있는 다양한 방안을 살펴본다.

영문 초록

The present research examines the systems of personal registration, resident registration and citizen registration in North Korea. The lack of interest in and understanding of these registration systems is not surprising, given the scarcity and limited availability of relevant materials and documentation on the subject. Despite the uncertainty over when and how reunification will take place on the Korean peninsula, it is essential that we prepare for such a historic event and its pursuant integration of the above registration systems. For such purposes this research focuses on the following. First, the personal, resident and citizen registration systems of North Korea will be studied in detail, with particular emphasis on their roots. Much attention will be given to the questions of how the systems were adopted and developed in the early years of the North Korean regime, and what impact the systems of the former Soviet Union and China had on their formation. Second, a comprehensive report of the personal, resident and citizen registration systems of North Korea will be provided based on a review and analysis of all publicly available materials, as well as such materials that until now have been either difficult to access or closed to the public. In addition, the research relies on first-hand accounts of the systems by North Korean defectors. By means of carefully structured interviews it was possible to identify the latest developments of the systems, thereby making it possible to update relevant information on the subject. Third, an important part of the research concerns addressing the challenges of integrating the systems of the two Koreas upon reunification. Different policies on setting up a single system of family registration and resident registration in post-reunification Korea are thoroughly considered. An analysis of such policies in respect of their lawfulness and constitutionality will also be presented.
