국문 초록

오늘날 국제관계는 국제기구를 빼놓고는 이야기할 수 없을 정도로 국제기구의 역할과 활동은 중요하며 또한 일상생활화가 되었다. 그런데 국제기구의 활동으로 인하여 경우에 따라서는 피해가 발생하기도 한다. 따라서 기존의 국가책임이론뿐만 아니라 이제는 국제기구의 책임이론 역시 정립할 필요가 대두되었다. 이 글에서는 2002년부터 시작된 UN 국제법위원회(ILC)의 관련 작업현황을 중심으로 국제기구에 대한 제3자의 책임, 제3자에 대한 국제기구의 책임으로 나누어 살펴보았다. 특히 후자는 피해자인 제3자에 대한 국제기구의 책임과 제3자에 대한 국제기구 회원국의 책임이라는 두 측면으로 나누어 분석하였다. 회원국의 책임부담 가능성 여부 및 부담시 그 법적 형태에 대해서는 아직 학설이나 판례 등 일치된 관행이 존재하지 않기 때문에 이에 대한 연구가 요청된다.

영문 초록

Today the roles and activities of international organizations(IOs) are ever more important and are penetrating deep into our daily lives, so that international relations cannot be discussed without mentioning IOs. Sometimes, however, losses or damages are being sustained as a result of the acts of IOs. Accordingly, we are faced with the necessity of establishing the legal regime of international responsibility of IOs as well as the existing regime of state responsibility. This article is an analysis on the law of responsibility concerning IOs with the classification of the responsibility of third parties toward IOs and that of the IOs toward third parties, on the basis of the related works of the UN International Law Commission(ILC). In particular, the latter has been further subdivided into two forms, the responsibility of IOs toward the injured third parties and that of member states toward them. The questions of whether member states should be responsible toward third parties and of eventual legal forms of such a responsibility require more research because of the lack of theories, judicial decisions or consistent practices.
