선화증권 위기의 해결책으로서 권리포기 선화증권의 법적 효력

국문 초록

국제무역거래에서 선화증권은 아주 중요한 무역서류로서 사용되었는데 선화증권 사용의 전제조건은 목적지에 화물보다 먼저 도착하는 것이다. 그런데 현재 근거리 운송에서는 선화증권보다 물품이 먼저 도착하는 사례가 빈번하게 발생하고 있어 선화증권을 상환함으로써 물품을 수화인이 인수하는 관행이 유명무실하게 되고 있다. 이러한 문제점은 선화증권이 가지는 권리증권으로서의 기능과 상환증권으로서의 기능으로부터 발생하고 있다. 국제적으로 이러한 선화증권의 위기문제를 해결하기 위해 해상운송장의 도입과 전자선화증권의 도입을 추진하였으나 해상운송장의 발행에 대한 선사의 기피현상과 전자선화증권의 도입지연으로 인하여 실질적으로 선화증권 위기문제를 해결하지 못하였다. 다양한 편법들이 이용되고 있고 권리포기 선화증권(Surrender B/L)도 그중의 하나이며 이러한 권리포기 선화증권의 사용에 따른 많은 문제점을 야기시키고 있다. 따라서 본 논문은 이러한 문제점을 야기하는 법적 효력을 살펴보고 있으며 향후 권리포기 선화증권을 사용함에 있어서 많은 시사점을 제공하고 있다. 따라서 본 논문의 연구목적은 권리포기 선화증권의 사용에 있어서 많은 문제점이 제기되고 있는 권리포기 선화증권의 법적 효력을 살펴봄으로써 권리포기 선화증권의 사용에 따른 분쟁을 사전에 예방할 수 있도록 하는데 있다.

영문 초록

There are lots of cases that the goods arrive at their destination before related documents in short sea transport though the precondition of using Bill of lading is that Bill of Lading arrives at their destination before the cargo. Therefore the practice is not useful that the consignee takes delivery of the goods with presentation of Bill of lading at destination. This problem results from the functions of Bill of lading such as document of tile and redemption. Sea Waybill and Electronic Bill of Lading was introduced to solve the crisis of Bill of Lading on a global basis but the shipping companies tends to evade the issuance of Sea Waybill and Electronic Bill of Lading is not used in the trade and shipping communities. So, the crisis of Bill of Lading has not been solved practically so far. To escape the crisis of Bill of lading, there are many practices that are used with unsettling the crisis of Bill of lading. As a practice, the surrender Bill of Lading is used in East Asia but there are many problems in using the surrender Bill of Lading. Therefore, the purpose of this paper is to contribute to the prevention of disputes in using the surrender Bill of Lading by studying the legal effects of the surrender Bill of Lading in view of traders’facing many problems in using the surrender Bill of Lading.
