국문 초록

베트남 민법은 1995년 제정된 이후, 2005년, 2015년 전문개정되었다. 2015년 베트남 민법은 2015년 11월 24일 국회를 통과하여, 2017년 1월 1일부터 시행된다. 모두 6개 편, 27개 장, 689개 조로 구성된 2015년 베트남 민법은 사회주의지향의 시장경제체제의 기본원칙을 구체화하고, 2013년 베트남 헌법에의 합헌성을 제고하며, 일반법으로서의 민법에 부합하는 체제를 갖추기 위해서 노력한 것으로 평가된다. 본고에서는 2015년 베트남 민법의 각 편별로 주요 개정 내용을 살펴보았다. 먼저 민법의 기본원칙과 法源에 관한 규정이 정비되었다. 법률의 유추적용도 불가능한 경우에는 민법의 기본원칙 · 판례 · 공평의 원리가 적용되고, 법원은 적용할 법규정이 없다는 이유로 민사사건의 해결을 거부할 수 없다는 규정이 신설되었다. 종래 권리주체로서 인정되던 가족호와 합작사가 삭제되었고, 성전환이 새로이 인신권으로 인정되었다. 법률행위에 있어서는 형식에 관한 규정의 미준수로 인해 무효인 법률행위와 법률행위가 무효인 경우의 선의 · 무과실인 제3자의 권익보호에 관한 규정이 정비되었다. 소유의 형식으로는 전인민소유 · 단독소유 · 공동소유가 인정되고, 재산에 대한 기타 권리가 새로이 규정되었다. 채권담보수단으로 소유권유보와 재산의 유치가 새로이 규정되었고, 사정변경의 원칙에 관한 규정이 신설되었다. 이자의 최고한도에 관한 규정이 개정되었고, 상속에 관한 시효 규정이 정비되었다. 아울러 외국적 요소가 있는 민사관계에 대한 준거법이 대폭 정비되었다.

영문 초록

Vietnamese Civil Code 2015(hereinafter referred to as ‘the Civil Code 2015’) was passed at 10th session National Assembly XIII on November 24, 2015. The Civil Code 2015 has 689 articles and is organized into six sections, 27 chapters. Under the Civil Code 2015, where relations arise within the governing scope of civil law but are not addressed by law nor agreed by the parties and no customary practice applies, provisions of the law governing analogous civil relations shall apply. and where analogous law cannot be applied, the basic principles of civil law, case law or equity shall apply. A court may not refuse resolution of a civil case for the reason that no provision is yet available to apply. Subjects of civil legal relations include individuals and legal entities. So households and cooperative groups are not subjects of civil legal relations in the Civil Code 2015. Gender transformation is carried out in accordance with law. Ownership rights comprise the rights of an owner to possess, use and dispose of the property of the owner in accordance with law. and other rights with respect to property means the rights of an owner who directly holds or controls property under the ownership of another owner. Other rights with respect to property comprise, (a) Right to adjacent immoveable property, (b) Usufruct, (c) Superficies. There are 3 forms of ownership. : ownership by the entire people, private ownership and multiple ownership. The Civil Code 2015 has revised performance of contracts when circumstances change substantially, interest rates and the law applicable to civil relations involving foreign elements.
